My company complained against me in Mohre after my resignation claiming training fees from me

My company complained against me in MOHRE after my resignation claiming training fees from me.

The claim was rejected by the MOHRE and they have now filed in Abu Dhabi FIC court against MOHRE's decision. I received a message that the case hearing is on 9th December.

My question is:

1. Do I need to submit anything before the hearing like a statement or anything else? I don't know Arabic, so can I speak English in front of the judge?

2. I want to get a temporary work permit so that I can work in another company during this case. Can the Abu Dhabi court judge issue me the temporary work permit during the hearing or there is a separate procedure to get that?

Prepare relevant documentation and possibly a statement before the hearing.

You can communicate in English during court proceedings.

For a temporary work permit, consult MOHRE as this cannot be issued by the court.

Thank you.

Mohre representative has told they cannot issue the temporary work permit it is up to court?

The issuance of the temporary work permit is contingent upon ongoing court proceedings related to legal disputes affecting eligibility or compliance issues.

Prepare a clear and concise statement outlining your side of the story. This statement should be factual, and evidence-based.

A lawyer can help you draft this statement. Collect all relevant documents, including your employment contract, resignation letter, training records, and any other evidence that supports your case.

There will be a translator in the court. Obtaining a temporary work permit is a separate process from the court case. We will discuss the possibilities in detail. Kindly share your WhatsApp number to discuss further.

Temporary work permit will be issued from the Mohre itself. hence the case is ongoing, you may obtain an NOC from the court.

Dear questioner

1. You may need to submit your case before the court according to the situation and procedures. The court may help by appointing a translator for you if you request the same, however, it would be better to appoint a lawyer if you have issues or confusion in dealings in the court.

2. The court cannot issue temporary work permits it is the MOHRE who issues work permits. If you are not able to get it from MOHRE due to the case, then you can request the court for an order to issue a work permit through MOHRE.

Yes, you may need to submit documents or statements before the hearing, depending on the court's requirements.

Typically, you would need to provide any evidence or documents related to the case, You should also prepare a statement to present your side of the case during the hearing.

If you're not sure what to submit, a temporary work permit during the case would typically require a separate process. The Abu Dhabi FIC court itself does not directly issue work permits.

However, if you are facing legal restrictions due to the case (such as a ban on working), you may apply for a temporary work permit through the UAE's Ministry of Human Resources and Emiratisation (MOHRE).

The court can issue an order or recommendation, but the actual process for obtaining a temporary work permit is usually handled by MOHRE.

If you need additional assistance, kindly share your Whatsapp number.

Welcome.

You should submit any documents before the hearing. You can speak in English in front of the judge, and a translator will be provided if necessary.

The judge cannot issue a temporary work permit during the hearing. You need to apply separately through the Ministry of Human Resources and Emiratisation.

We recommend contacting our center for detailed legal advice.
