Will the contract be automatically canceled if the bank does not process the mortgage?
Q: Hello, Legal Advice ME I am writing to seek your advice on my ongoing process of buying an apartment. I have signed contract F, which is valid until 15 Aug 2024. My plan was to buy it financed by a mortgage. I got my pre-approval and signed the contract, then passed it to the agency to complete all needed paperwork. The agency took over with the bank, and then I found out that the apartment, although not a hotel, is listed as a hotel apartment on the title deed. The bank said processing this would take a very long time. I applied with a different bank, again all pre-approved, but as soon as they found out about the property type stated on the title deed, they said they cannot finance it. My questions are: - If the first bank is unable to process all the paperwork on time, will the contract be automatically canceled? - Can I cancel the contract based on the fact that I was not made aware of the property type stated on the title deed before signing the contract? Would I get the 10% deposit back?

I sent my tenant and eviction notice but the date for the tenancy contract in Arabic was wrong. What to do?
Q: I sent a legal notice to my tenant through Dubai court for eviction. But the dates for the tenancy contract in the Arabic portion are wrong. The dates in English are correct. The notice was sent on 13th June. What do you think should be done now? Do I need to send it again or the judge will consider it?

Q: Hi there. I have taken a villa for rent in Mirdif, Dubai, and the owner handed over the property in an unlivable condition. So I didn`t want to stay in the property and wanted to end the contract. Should I file an appeal in family court to cancel maintenance if my ex-wife got job?
Q: The court judgment issued yesterday rejected the divorce case filed by my wife and ordered me to pay her AED 2000 monthly as marital support as she is living separately. Additionally, I have filed a restitution case against her to return home, which will begin next week. Should I file an appeal in court to cancel this monthly amount or wait until the restitution case ruling is finalized? Please note the following: 1. Q: Dear lawyers, I have been divorced mutually in Dubai. The children have been living with me because my ex-wife chose to live with her boyfriend. Due to financial conditions, she chose a new life with a new man, abandoning the kids and her past. Now, as I legally want custody, she is creating drama, and her current boyfriend is taking advantage. She had a relationship with him before the divorce. I couldn`t file for adultery as I was focused on my career and children. Can I do it now? All evidence is present. The children are residing in Dubai, and she has completely stopped meeting them as her boyfriend controls her. He is married too and has children he has kept abroad.+1

How can I take my kids to home country to protect them from my abusive husband?
Q: Dear Sir/Madam, My husband is refusing to renew my residency, and without it, I will lose my job by the end of this month. Since he wants me to go back to Nigeria, I asked him to allow me to take my kids, but he refused. I can`t leave the kids alone in Dubai because he constantly abuses them physically, verbally, and psychologically. When he is angry, he beats them with a drumstick even when they do nothing wrong and threatens to send them to a village in Nigeria to work on his dad`s farm. He slaps them hard, and the boys cry to me for comfort. He asked them to call me a witch and a bad person. When I was not working, he beat me constantly, saying it was because I was lazy and refused to get a job, despite my explanation that I had been trying. I need legal advice on how I can be allowed to take the kids with me back to Nigeria. Please, I want to find out what I can do.

Q: Dear Sir/Madam, According to Emirati law (361 of the Family Code), any "heela" (legal stratagem) that causes the circumvention of the law can be nullified. Does that pertain to inheritance cases? For example, if a man gives away most of his assets to his wife but does not provide anything for his children, and then he dies, can this be challenged on the basis that the man tried to avert the requirements of the law in distributing his assets fairly? I canceled the Ejari for my tenant after he subleased my apartment. Can I file a case?
Q: I am a landlord. I gave my apartment to a guy who did not pay any rent and used my apartment for subleasing. I got so angry that I canceled the Ejari online on DLD and it got canceled easily. Now I sent an eviction notice to the tenant as the tenant is absconding and granted a broker his POA. So I am planning to file a case in RDC. Will it be accepted or rejected as I canceled the Ejari?
