Can we expedite a medical error case while the final DHA report is delayed?
Q: Dear Sir/Madam, We received a report from DHA stating that there has been a gross medical error since May 2023. The doctors then asked for a grievance, and we are still waiting for the final report from the High Committee. It`s been almost a year since the first report was shared, but there has been no progress yet. Is it possible for our lawyer to ask the court to accelerate the case or use the first DHA report, considering the delay in receiving the second one?

If my father's creditors sue him or his company, will my company be liable?
Q: Dear Sir/Madam, My father used to be in business around 7 or 8 years ago in Dubai, but due to financial problems, he had to close it, and he has pending bank loans and bounced cheques from private parties. I have recently started my own business in Dubai, and his creditors (private parties) have approached me for the money, which I cannot afford to pay. If any of those creditors file a case against him or his company, will I or my company be legally liable to pay? Can they file a court case against me?

المستأجر في السجن. كيف تجدد زوجته عقد الإيجار؟
س: السلام عليكم ورحمة الله وبركاته، يوجد مستأجر سُجن بسبب قضية وحاليًا تسكن الشقة زوجته وابنه وهي تدفع الأجرة بدون أي تأخير. انتهى العقد. هل يمكن تجديد عقد الإيجار تحت اسم الزوج وزوجته توقع مكانه؟ أم يجب ترك العقد بدون توقيع؟ أم يجب إبرام عقد إيجاري جديد باسم الزوجة وفي هذه الحالة يمكن تغيير الشروط والأحكام والقيمة الإيجارية؟ أرجو منكم الإجابة!

What's next if a tenant won't pay or vacate despite winning the case in RDC court?
Q: Dear Sir/Madam, The tenant didn`t pay rent for over 7 months. I filed a case, and finally won; the RDC court verdict is to evict the tenant and for them to pay all rent and legal fees. I contacted the tenant, who refused to move out or pay. What`s the next step? Do I file for execution via RDC, or will it be automatic? How much does it cost, and how long does it take? The tenant is arrogant and said he will not pay until I proceed with execution from RDC, and then he will ask for a one-year payment plan! The whole procedure is very unfriendly to the landlord, with the tenant risking nothing while the landlord incurs lawyer fees, interest losses, and significant time and effort.2024/05/14

Q: Dear Sir/Madam, I left the flat with 2 months` prior notice and gave a DEWA clearance certificate to the building management. Now they are claiming compensation for a damaged door, amounting to AED 9000, and they have my deposit of AED 2000. What's more important: the tenancy contract or UAE rental laws on tenancy renewal?
Q: Hello, I hope you can advise me, please! I`m a tenant in Dubai. The owner/agency didn`t send me the rent increase notice 90 days in advance. It was sent to me on Thu, 18 Apr, 22:16. My lease expires on June 24, 2024. So it`s 78 days instead of 90. But they claim that in the signed contract there is a statement: "In the event that the tenant wishes to renew the lease at the end of the tenancy, they should notify the landlord in writing 90 days prior to the expiry date of the rental contract." Since I didn`t do this, they demand to increase my rent by the maximum amount possible as per RERA. As far as I can understand, according to the law, if no one notifies anyone before 90 days, the default is to extend the lease. So there is no increase. What is more important according to law, the signed contract, or UAE laws in this case? Thank you very much, hope you can advise and help me!

The apartment has been sold to a new owner. Is the tenancy agreement still valid?
Q: Hello, This is related to a tenancy contract. I`m staying in an apartment on rent and the lease is about to expire. I had agreed with the owner that I would move out at the end of the lease period. Recently, the apartment was sold and the new owner is saying that my rental agreement with the old owner is null & void (as the owner has changed now), and I`ll have to get into a new agreement with him on exactly the same terms; there`ll be no economic impact on me. Am I legally required to get into a new tenancy contract with the new owner for the remaining term? Do I need to get into that complication?
