Negotiate asset split and spousal support: direct talks, mediator, or lawyer negotiations?
Q: Hello, I am currently getting divorced from my wife in Abu Dhabi. We are Americans, got married in the US 6 years ago, and are both non-Muslims. We are officially divorced and we wrapped up custody proceedings for our 19-month-old daughter last week and it was decided for 50/50, joint custody. I believe the next stage is for asset split and spousal support. Is that best handled with one-on-one talks with my ex-wife, or the use of a moderator, or have lawyer-to-lawyer negotiations? Also, can spousal support be paid from the former wife to the former husband? In the US this is very possible. I am very concerned about this as my ex-wife makes considerably more than I do (we moved to Abu Dhabi so she could take a lucrative position). Thank you!

Can I force my wife to let me live with her and our children during Khula proceedings?
Q: Dear Lawyers, My Muslim wife filed for divorce in my absence, and when I returned to the UAE, I found that she had taken a new tenancy contract in her own name, not allowing me to live with her and our two children. She is taking Khula. Can I force her with a criminal case to let me live with her since the divorce and custody are not finalized yet? Can I also file a criminal case for child abduction?

Do I need my ex-husband’s permission to travel abroad with our child?
Q: Dear Lawyers, I’m a divorced mother with custody of my 4-year-old son from Dubai Courts. My colleague recently traveled to Turkey, and she was asked to provide an NOC from the child`s father. Do I need an NOC from my son’s father to travel? I don’t have a travel ban. I traveled with him once two years ago without any NOC and didn’t face any issues. Would I face any problems if I travel? My son’s father isn’t involved in his life and doesn’t really care. Do divorced parents ever get stopped at airports if they don’t have a travel ban?2024/08/11

Should I visit the Evacuation Department in person to complete the eviction and get my keys?
Q: Dear Lawyers, I opened an execution case against my tenant who was not vacating the apartment and was not paying the rent. After the execution date, I received a report from the police that the apartment is being evacuated. However, when I created a "Request to follow up execution proceeding" e-request to complete the process and get the keys, my request was rejected with the message "على مقدم الطلب مراجعة قسم الاخلاء," which translates to "The applicant must refer to the Evacuation Department." So, do I need to personally visit the Evacuation Department? I am outside the UAE but can come to the UAE to get the keys. Or, do I need to create an e-request in a different category?

Can I charge my friend with breach of trust for not sending money from my property sale?
Q: Hello, I gave an online POA to my friend, who has a UAE residence visa, to sell my property. I gave another online POA to his brother to receive money on my behalf. I do not have a residence visa. They did not provide me with a copy of the POAs. He sold my property in JLT, and his brother received the money, but they did not send the money to me. Can I now open a case against them with the charge of "breach of trust" or any other charge that suits this case? Thanks a lot!

What can I do if my company is pressuring me to sign an unfair new contract?
Q: Dear Lawyers, I joined a company in Dubai. According to the contract agreement given to me by the company, if I leave before the fixed contract period, I have to give two months` notice and pay a sum of 6000 dirhams. I agreed to this and continued to work under that agreement. However, the company has now introduced a new contract agreement, and all employees are under pressure to sign it. The new conditions state that no employee can take a similar job in the UAE and must agree to pay USD 3500 (AED 12600) upon leaving during the contract period. Q: Dear Lawyers, I won a maintenance case against my husband and initiated an execution case. I requested the Honorable Judge to write a letter to my husband`s employer, obliging them to seize 25% of my husband`s salary. The judge agreed. Q1: Does the seizure include 25% of my husband`s allowances, bonuses, and commissions, or only 25% of his basic salary? Q2: The judge issued a letter, and I received a copy by email. Does the court also send the letter directly to my husband`s employer, or am I supposed to forward it to them?

Are WhatsApp messages and bank receipts valid evidence against a scammer friend?
Q: Hello! I got scammed by my friend. She asked me to give her money, promising to return it, but when I asked for my money, she refused to give it back. There’s no contact between us except for WhatsApp messages, and I transferred the money to her via bank (I have the bank receipts). A few days later, I discovered that she scams many people like this, including her colleagues. She claims that she’s broke but uses this money in stock trading. Everyone is afraid to come forward because they don’t want to spend money on a case they believe they will never win. People around me told me that without a written agreement, I can’t go to court because I will definitely lose. They said, “You don’t have any solid evidence.” However, I have WhatsApp messages and know three people whom she scammed and took thousands from. What do you advise me to do? Should I go to court, or should I let it go because I’ll never win?

A new owner wants to increase the rent beyond RERA guidelines. What should I do?
Q: As`salaam Alaikum, Good Morning! I live in Dubai and have rented an apartment since November 14, 2022, which I renewed on November 13, 2023, for a year at an amount of 41,800 AED (4 cheques). Three to four months ago, the owner sold the apartment to a new person, and I had to change 2 payment cheques to the name of the new owner, one of which has already been encashed. Now, as the renewal date (November 13) approaches, the new owner is asking for a rent increase of 5,000 AED. I live in Dubai Silicon Oasis, and according to the RERA rental index, the maximum rent increase is 2,090 AED, which I informed the new owner. However, the new owner insists that, according to RERA, they can increase the rent by 5,000 AED. I have researched extensively but found no information indicating that a new owner can increase the rent by this amount. Could you please clarify if the new owner can increase the rent by 5,000 AED? How should I proceed if the new owner goes against RERA guidelines?

How long does Dubai court take to enforce child support if the father fled the UAE?
Q: Good day, I won a case in Dubai court. I am the mother of two kids, 17 and 6 years old. The father has to pay a certain amount for our kids. Can I block a new Ejari registration to prevent the landlord from re-renting the property?
Q: Dear Lawyers, What are my rights in terms of eviction? My landlord tried to increase my rent by 20% (per the RERA system, they were entitled to zero increase). We offered inflation as a response (all done via email). After they accused us of being cheap and we reminded them that the system indicated no increase was applicable, they issued us an eviction notice for "family use." We have since moved out, but now they are saying they will be selling the property and are providing us with a long list of maintenance items they want to withhold from the deposit (replacing water heaters, roof tiles, wheels on sliding doors), all of which were functioning properly during the nearly 3 years we lived in the house. We suspect that now we are out, they will refuse to refund the deposit and will rent the house out again. I have heard you can block the registration of a new Ejari for rental. What is the process for this, and do I have any other rights based on the above situation? Thanks!2024/07/29

Q: Dear concern, We booked a photography company last month for my son`s birthday party, and the service from the photographer was really disappointing.
