Should I visit the Evacuation Department in person to complete the eviction and get my keys?
Dear Lawyers,
I opened an execution case against my tenant who was not vacating the apartment and was not paying the rent. After the execution date, I received a report from the police that the apartment is being evacuated.
However, when I created a "Request to follow up execution proceeding" e-request to complete the process and get the keys, my request was rejected with the message "على مقدم الطلب مراجعة قسم الاخلاء," which translates to "The applicant must refer to the Evacuation Department."
So, do I need to personally visit the Evacuation Department? I am outside the UAE but can come to the UAE to get the keys.
Or, do I need to create an e-request in a different category?
Dear Questioner,
The message "على مقدم الطلب مراجعة قسم الاخلاء" indicates that you need to physically visit the Evacuation Department.
This is often a requirement for finalizing the eviction process and obtaining the keys to the apartment. The department might require personal verification to ensure you are the rightful owner of the property.
If you are outside the country, you can issue a power of attorney to any of your close relatives or lawyers.

You have to give us a power of attorney to solve all this issue.
Dear Questioner,
If your follow-up on the eviction process was turned down and you were directed to the Evacuation Department, here’s what you can do:
1. Reach Out to the Evacuation Department:
Since your initial inquiry was redirected, it's best to contact the Evacuation Department directly. Ask them what specific steps you need to take to get the keys to the property after the eviction.
2. Think About Legal Help:
If you can’t visit the Evacuation Department in person, consider hiring a lawyer or a property management service to handle the communication for you and help make sure everything gets sorted out.
3. Get Clarity on the Process:
When you speak with the Evacuation Department, make sure to clarify any additional paperwork or procedures you might need to complete before you can get the keys.
4. Look into E-Request Options:
If needed, see if you can submit an e-request under a different category as suggested by the Evacuation Department. This could help ensure your request is processed correctly.
By connecting directly with the Evacuation Department, seeking help if needed, and following the required steps, you can move forward with the eviction process and gain access to your property.
If you want to receive the key, and there is an official report stating that the apartment has been vacated, and a note saying that you need to check with the eviction department, it means the key is there and you can collect it from them.
There is nothing else to request.
Thank you for reaching out with your query about the execution process regarding your property and the tenant's situation.
It seems that you're nearly at the end of this process, and I understand the importance of finalizing it smoothly.
The message you received, "The applicant must refer to the Evacuation Department," typically means that there is a requirement for a direct review or an additional procedure that needs to be handled in person.
Since you mentioned you are currently outside the UAE, this could complicate matters slightly.
I can assist you by representing you on-site to handle this matter with the Evacuation Department, ensuring that all necessary follow-ups are made efficiently and effectively.
This would negate the need for you to travel to the UAE merely for this purpose, saving you time and resources.
Please reach out to me directly at [--------] or via WhatsApp to discuss this further, and we can arrange the necessary representation and ensure that the transition of the apartment keys happens without further delay.
