Can we stay until the contract ends despite management change and rent increase?
Q: Hello, Our building management is changing, and we have a contract with them until November 15, 2024. We have paid up to that month. On August 24, they messaged me on WhatsApp that they are changing management effective September 1, 2024. They only gave us a 7-day notice, which was not written but only communicated via WhatsApp. The new management is now saying that they will increase the rent to 70K, while our current rent is only 46K. This massive increase is too high, and the notice is too short. Do we have the right to stay in the property until our contract ends, even though the management is changing?

Q: Hi, good morning, I’m an Indian residing in the UAE and want to apply for a divorce. My husband and I have been living separately for more than 3 years, and he has been living in India since our separation. We are both Indians and Christians (non-Muslims). We have a son who is 8 years old now. Can you please let me know the divorce procedure if we want to proceed in the UAE, both with and without mutual consent? Additionally, please advise on how to proceed with custody, as my son currently resides with me. Thank you!

On sick leave. Can my school make me resign? What are my rights if they do?
Q: Hi, I’m a teacher in Dubai and have been given a medical note for sick leave due to mental health. I am currently still in the UK because I found boarding the plane extremely overwhelming in my state, so my sick note was issued by UK doctors. Do I need a Dubai sick note too? My school has given me the option to resign, but I don’t want to do this as I plan to return to work after receiving therapy and medication. What are my rights? I have worked at the school for a year and have a total of three years of teaching experience in Dubai. This is the first time I have ever needed medical sick leave in my entire 10-year career. I know that labor law states I am entitled to 90 days of sick leave, and I don`t think my school can dismiss me. However, if they do, will I be entitled to any pay or gratuity? Thanks!

Q: I own a property in Dubai and we issued a 90-day notice to the tenant to advise of the rent increase. The tenant accepted and confirmed they would be renewing the tenancy agreement. Before they signed the new tenancy agreement they moved out without giving any notice. What are my rights in this scenario?

What can I do if I resign during probation and the employer asks for compensation?
Q: Hi, I am now serving my notice period in the company in my probation period. However, they are asking me for a 7000 fee which I am not aware of. I was told that I agreed to this and signed the contract which is not true. I repeatedly requested a copy of my contract for months, yet I have not received any. Due to the lack of response, I checked the contract through the app and found that it was electronically signed. I do not recall signing this contract, nor did I receive any digital copy to sign. Does my release from the police mean the complainant dropped the case?
Q: Dear Lawyers, I was detained yesterday at Al Barsha Police Station regarding a complaint against me for theft. I was released this afternoon. The police told me I am released, but they didn`t give me any paperwork. My relatives went to the police station, and they were informed that I am "clear" and released. I checked the Dubai app with my case number, and there is no judgment date, session number, or prosecution date. Does this mean the complainant dropped the case and the travel ban is lifted?

Does signing a new contract after receiving an eviction notice make it invalid?
Q: Dear Lawyers, My landlord issued an eviction notice dated 31st July 2023, stating that I should vacate the property by 31st July 2024. However, on the same day, the agency acting on behalf of the landlord sent an email saying the landlord agreed to sign a new contract with a 5% increase. On 2nd August 2023, I signed a new contract, which is valid from 14th November 2023 to 13th November 2024. It was signed by the landlord, and Ejari was issued until 13th November 2024. Now I want to renew the current contract, but the agency is saying there is an eviction, and I need to vacate the property. My understanding is that I signed a new contract after the eviction notice, and therefore, the eviction is no longer valid. Am I entitled to renew the current contract, or do I need to comply with the eviction and leave the property?

Can a landlord enforce a higher rental increase if the initial notice had a wrong percentage?
Q: Hello, I`d like to ask: What if a landlord mistakenly mentioned the wrong increase percentage when sending the 90-day renewal notice to their tenant? The correct percentage should be higher according to the RERA Rental Index Calculator and the tenant is now refusing to accept this additional increase. Can the landlord still fight for it if the tenant insists on renewing through the DLD instead?+1
