Can I upgrade and gift an apartment to my husband after evicting a tenant?
Q: Hello, I purchased a property last year that was already rented. I then issued the tenant an official notarized eviction notice of one year. The tenant has now vacated the apartment. I plan to upgrade the apartment and gift it to my husband. Will the former tenant have any legal rights against me if I proceed? Is it legal to give a 10% deposit cheque to an agent before signing Form F?
Q: Hello, I`m about to buy a property in Dubai on the secondary market and have some questions. The agent sent me a link to the Real Estate Brokerage Contract with the following note: A 10% deposit cheque will be given to our agency under the seller`s name for the XX apartment. It is non-transferable without consent from both parties and will be returned only by judicial order in case of a dispute. Is it legal to hand over a physical deposit cheque to the agent under the owner’s name before signing Form F, with the mentioned note? If I give this cheque before signing Form F, will I get it back if I change my mind? My rights are not protected here if the owner changes his mind before signing Form F. I tried to verify the title deed ownership on the DLD site, but it shows "Records not found." The agent said this happens sometimes because the owner didn`t update their details two years ago when they bought the property, and everything will be validated at the trustee office. As a partner who loaned money to the company, should I sue the company or my partner?
Q: Dear Lawyers, I am a 50% partner in a company. I had given a 2M AED loan to the company about 10 years ago. There are expert reports and bank records to prove the loan. The company does not have any bank balances or assets. Should I start a lawsuit against the company and demand 2M AED, or should I start a lawsuit against the other 50% partner and demand 1M AED? One benefit of suing the company is that I can obtain an acknowledgment of debt, and later in an execution case, I can issue a certificate of solvency to have the other partner arrested. However, suing the other 50% partner directly would include their name in the executive writ. Please guide me! (I believe all necessary legal information is provided here. Are the partners of an FZLLC liable for the company debts from their own money?
Q: My company is FZC - Free Zone Limited Liability Company (FZ-LLC). The company is incorporated in the Free Zone with 2 shareholders and has 2 licenses- Commercial & Industrial and has a warehouse for stocking the goods. Every year when the license is renewed, the warehouse rental is also renewed. In the last 4 years, the licenses and warehouse are not renewed and the warehouse is not handed over to the Authorities. The Authorities filed a legal case saying that the warehouse rental needs to be paid for 4 years, and only then the premises can be vacated. Then the judge issued the verdict saying that the owners are liable to pay. Since the owners cannot pay the amount, the judge orders travel bans and arrest warrants for the owners. The company is LLC, which means in general, the owners of an LLC are not personally liable for the debts of the company. This means that if the company is sued, the owners are not responsible for paying off any debts with their personal assets. Am I right? أسئلة وأجوبة

Q: I booked an off-plan property with a developer in a project in Dubai. I have paid 10% + 4% DLD. It`s been 2 months and still, I don`t have SPA. Plus, the above amount is in favor of the developer`s account and not escrow. Please advise if this is normal and what questions I should ask the developer. Can I cancel an apartment I bought an get refund if the developer did not provide the requirements?
Q: Hello, I made an EOI payment for one project with a developer in Dubai. In the agreement, it says if the seller is able to allocate the unit similar to the buyer’s requirements, in this case, it’s not refundable. However, I am not happy with the unit and it doesn’t meet my requirements. For example, the view of the unit and the fact that it is on the last floor, the last floor doesn’t work for me although I requested a high floor. And the unit has a city view although I requested a garden/park view in the EOI. At this point, I canceled the purchase and asked for a refund to which I got a response that according to the terms and conditions of the EOI, it is not refundable which is not correct. Q: Hi sir, I am from India. I was previously in the UAE before the COVID-19 pandemic, but unfortunately, I was unable to return due to the pandemic.
