Can I file a warrant of arrest against POA holder if not listed in trade license?

Q: Good day! I am seeking to get advice about my labor case. I filed a case against my company in 2021. In July 2022, my case was won. However, I have not yet received my money. When I called the Abu Dhabi Judicial Department, the call center representative said I should go to any Enjaz office and request a MOA (Memorandum of Agreement). I should then file a warrant of arrest against my previous company. The owner of the company is not listed on the trade license. I believe the owner is his father, who lives in India. The person who is responsible for the company has only a POA (power of attorney). My question is, can I use the name of the person with the POA on the warrant of arrest, instead of the name on the trade license? Thank you for your advice in advance. I appreciate it!

Can I terminate the SPA for an off-plan property and get full refund if I didn't receive the SPA?

Q: I booked an off-plan property with a developer in a project in Dubai. I have paid 10% + 4% DLD. It`s been 2 months and still, I don`t have SPA. Plus, the above amount is in favor of the developer`s account and not escrow. Please advise if this is normal and what questions I should ask the developer. Can I withdraw the money from the developer? Will he be liable to hold any % of my money for cancellation?

What can I do if my company gave me bonus less than the amount we agreed on?

Q: I work in DAFZA. My company does business in USD. My company gave me a target letter that if I did X amount in Euros, then I`ll get AED 57K as an incentive. I managed to do 102% and was expecting an incentive payout accordingly. But they gave me a bonus as per 94% target achievement. They mentioned that the exchange rate was favorable all throughout the year for USD. But if they calculate the sales at the original exchange rate used while deciding the target, I have achieved only 94% of my target. 2 things: 1. They never mentioned in writing anywhere that the final calculation would be based on the fixed exchange rate. 2. Target versus Achievement as per our ERP system, which I used for tracking my achievement status showed me the result as per the actual exchange rate on that day and hence I assumed that I hit 102%. No one pointed out in the whole year that my achievement was not 100% and there`s is nothing in writing reflecting that. How can I ensure that my company pays me the correct amount?

Can the MOU with the property buyer be extended after expiry without my approval?

Q: Hello, I have signed an MOU without any deposit and the MOU expired today. The broker and buyer did not turn up to close the deal and the MOU expired today. I spoke to another broker but he said that while raising Form A, it`s showing Contract F exists. Earlier it was showing to him Active Contract F exists but now after the expiry of the MOU, it is showing that Contract F exists. How can this expired MOU be still effective?

Can I still cancel my form-F contract after 20 days if I don't get a loan?

Q: Dear Sir/Madam, I have a form-F contract with a seller. The contract says that if I do not get a loan, I can cancel the contract after 20 days. I spoke to my agent on WhatsApp, and I was still within the 20-day period. On the 24th day of the contract, I sent an email to my agent to cancel the contract. However, he said that I am now 4 days late. He also mentioned that the sale is cash. After all of this hassle, I see that he is being difficult with me, even though he is my agent. He now says that we still have 18 days to sign the contract, and if I do not sign, he will hand over my security deposit check to the seller. I do not want to lose my 10% deposit, so I am looking for options. I found a friend who wants to buy the villa, but he does not want to apply for a NOC from the developer under a different name. The agent is being difficult and rude to me. Can someone help me with some advice? Also, the agent I have been in contact with is not the same agent who signed the contract. I do not even know this person.

Tenant wants to leave apartment early after eviction notice: Is he entitled to a refund?

Q: Dear Sir/Madam, I am in the process of selling an apartment that is tenanted until February 2024. In April 2023, I served the tenant with an eviction notice due to my plan to sell, which means he has until April 2024 to leave the apartment. The contract stipulates that he is liable for two months` rent for early termination. The tenant has informed me that he wishes to leave immediately and is demanding a refund of rent paid for the entire remaining period of the contract. He claims that, according to the DLD, he can leave with no notice and without any penalty due to the eviction notice. Is he correct?

Is a 3-year-old POA valid in Dubai?

Q: Hello Experts, I am in the process of buying a townhouse in Dubai (Mira Oasis). I am a Dubai resident, but I am currently outside of Dubai. Unfortunately, I am unable to travel to Dubai to complete the DLD transaction. I have given my brother a full power of attorney (POA) in Dubai to carry out all transactions on my behalf, including property transactions. The POA was created three years ago. Can he carry out the property purchase and registration process on my behalf with a three-year-old POA? There is no expiry date mentioned on the POA, but I have heard that POAs are generally valid for two years only. Appreciate your advice!

How to protect yourself when signing a tenancy contract of a warehouse?

Q: Dear Sir/Madam, We are in the process of setting up our company in the UAE. We have found a warehouse that fits our requirements and we have paid the security deposit and the agency fees. We would like to confirm some points before signing the contract: - Notice period: The owner said that we should inform him one month in advance if we want to leave and exit the contract. Is there a clause in the DREC contract that states this? Are there any penalty fees? How can we avoid any problems with this? - No Objection Certificate (NOC): The owner promised to give us an NOC after the contract is signed to allow us to upgrade the power and install air conditioning. How can we make sure that this happens? Should we have him include this in the contract terms? In general, can we trust their promises or should we get a letter before signing the contract? Note that they are refusing to give us an NOC and we have been told that we took too long to finalize the contract. Thank you for your attention to this matter!

Unjustified rent increase: What are my options?

Q: Dear Sir/Madam, I am writing to seek your advice on a matter related to my tenancy. I am facing some concerns and uncertainties. Recently, my landlord proposed an unjustified rent increase of 9,000 AED. The RERA calculator clearly indicates that the increase should be only 3,000 AED. There was mention of going through the Rent Valuation process, but since our last communication, there has been no further response from either the landlord or the real estate agent. My concern is that my tenancy contract is due to expire in just a couple of days, and I have not received any communication regarding the renewal process. I had previously sent an email inquiring about the rent contract and the collection of rental cheques, but unfortunately, there has been complete silence in response.      At this point, I am unsure about the next steps to take. I genuinely want to ensure that everything is in order and that I can continue my tenancy without any disruptions or uncertainties.

How to sue a subcontractor for breach of trust and conflict of interest?

Q: Greetings, We have issued a Letter of Purchase Order (LPO) to our subcontractor for a project. The payment from the main contractor has been delayed. To speed up the process, we have asked the main contractor to pay the subcontractor on our behalf through a No Objection Certificate (NOC). Since the LPO is from our company, the subcontractor has asked us to give a security cheque in case the payment is further delayed. We have issued the cheque along with a letter stating that they have to return the cheque upon receiving the cheque from the main contractor. The guarantee cheque was used after 3 months even after getting the payment from the main contractor. The subcontractor has started communicating with the main contractor without keeping us in the loop. Due to cash flow problems, we were supposed to leave the project. Can I approach the court asking for the same/twice the amount as compensation due to a breach of trust and a similar amount as a conflict of interest?
