Q: Hello, I am planning to resign from my job because I can no longer take the pressure I am getting every day. I am only 4 months into the company. It is a limited contract. This is what bothers me: in the contract I signed, it says that I have to pay the training cost of 5000 AED if I resign before 1 year. - Will I pay that amount if I resign during probation or even after 6 months? - If I resign after 6 months, will I still have to pay the full amount or half? Can I send my tenants eviction notices if they did not agree on the rent increase?
Q: My tenants wish to renew their contracts but unfortunately, we are unable to agree on the increased rental price to reflect the significant changes in the market over the past year. Instead, they quote that the RERA rental price index suggests that no increase is in fact allowed despite the fact that no property can be found at that price in the same area. Given the fact we are unable to agree, am I correct in my understanding that now I must give them a new contract upon the expiry of the old one at below market rates? Also, can I invoke the 12-month notice period to vacate, as stated in their current contract (I could have done this before now but chose not to), via email? How to increase rent to match market prices?
Q: Dear Sir/Madam, My tenants would like to renew their tenancy contract for another year. However, property rental prices in the area of my property have increased by 30-35% in the last 12 months. As I am not a wealthy landlord (the property was purchased from my pension funds in order to provide me with an income), is it acceptable for me to increase the rent to align with current market prices when preparing the new contract? Please note that the RERA index calculator does not appear to reflect current market prices, so I am unsure of the best course of action or what my options are. How to transfer the shares of a company from his heirs to the partners?
Q: A company is registered in a free zone (Dubai South) and had 4 shareholders. But now one of them passed away and the successor is a very old lady, who is not cooperative and will not be able to sign any document at all (and she lives in another country). We have no idea who will be a successor after this old lady and these people will in fact never be interested to do anything with this company. The company is financed and managed by only one shareholder, who is willing to continue. What can be done in this scenario to keep this company and continue operations? How to transfer the shares of the deceased shareholder (buyout, shares transfer)? What happens to the rent increase and eviction notice upon selling the property to a new owner?
Q: I am a tenant in a villa. The landlord wants to sell the property to a new owner who wants to move in. My rental agreement is till August 15, which means my 90-day increase notice is due on May 15. Three parts to this question: 1. If the current owner serves me a 12-month notice, can the new owners still increase my rent? 2. If the current owner doesn`t accept my counter-offer for the rental increase that he served before the notice (My offer is in line with the RERA calculations, but his is not), can he legally increase my rent if I get an eviction notice? 3. Can we terminate an employee who left the country without informing us?
Q: Hello, We have an employee (under probation) who left the country secretly thinking that we will never find out. He exited the country on March 14, 2023, and continued to work remotely. On March 20 & 21 he took an emergency leave so I started investigating and requested an exit/entry report from immigration. On March 23, 2023, we temporarily disabled his email and other company accounts. Yesterday (March 28), we finally received the immigration exit report which shows he exited on March 14, 2023.
