Q: Assalamu Alaikum My ex-wife and I live in Canada. We co-own a property in Dubai. I own 75% of a property and my ex-wife owns 25%. I want to sell my share of the property. She refers me to her lawyer in Canada who doesn`t practice law in Dubai. I don`t want to spend extra fees when corresponding with her counsel in Canada. Should I go to Dubai court and force her to buy my share or sell hers?

Q: Dear Lawyers, I have received an eviction notice from my landlord to vacate the property for his personal use. Then, in August 2024, he communicated with me via WhatsApp and email that he wants to sell the property. I met with him to find a solution, and he said that if I raise the rent, he will let me stay and renew. However, the price he is asking for is not justified, and according to the RERA index, no rent increase should be applied. To resolve this issue, I offered a 10% increase, but he refused. Am I eligible for renewal at the same rate I am currently paying?

Q: Dear Lawyers, I am seeking advice regarding a situation with my tenancy contract renewal, and I believe it may require your assistance. My current rental contract is about to expire, and I informed the agent responsible for my contract three months ago that I intend to renew. At that time, the agent did not mention any rent increase. However, with only 15 days left to renew, the agent has now requested a 10% rent increase. I did not agree to this, but in good faith, I proposed a 3% increase, which aligns better with my family’s budget. The agent accepted my proposal but has now added new clauses to the contract, which were not discussed earlier. I do not want to accept these changes. I would like to understand if these last-minute changes are compliant with tenancy regulations and what steps I should take to proceed.

Q: Hello, My tenant`s contract expired in August 2023. I understand that, by law, it automatically renews for a year if there was no communication between the tenant and landlord. Based on this, the contract was renewed until August 2024. Now, my tenant has informed me that they plan to vacate the property in September with only 10 days` notice. When I refused and stated that a 3-month notice is required, they claimed the contract is no longer valid and has expired. I would like to know if the contract automatically renews each year, meaning if it expired in August 2024, did it get renewed again until August 2025? Thank you!

How do I handle a non-paying tenant with pending cheques and no contract?
Q: Dear Lawyers, My tenant in Dubai consistently pays rent late, and we did not renew the contract when it expired on December 23rd. However, I accepted post-dated cheques from them. Currently, two cheques for 32,000 AED are pending, and another for 16,000 AED is due on October 6th (covering rent for November and December). They signed a letter stating that if they do not pay by the end of September, they will vacate by October 1st. They’ve been late before but eventually paid. Now, they are not responding to my follow-ups, and I’m concerned they may leave without settling the rent. My questions are: 1. How long can I stay if the owner sells the property after I declined the rent increase?
Q: Dear Lawyers, I started renting a unit in November 2023. The property manager offered a higher rent for renewal, even though the RERA index showed no increase in August 2024. I refused and said I would follow the RERA index. Last week, the property manager informed me that the owner wants to view the unit because he is planning to sell it. I asked for the price, and the manager said 2.5M, while similar units are on sale for 1.5M. Can I terminate the tenancy contract is the tenant did not pay on the agreed time?
Q: I have a property to rent in Dubai and found someone to rent it. He paid the deposit and both parties signed contracts. The move-in date was the 12 September and he stated that he would pay the three cheques on the 12 September by 2.00 pm. No payment arrived on 12 September so we are planning to pull out. He did send a picture of 2 cheques and offered to make a payment late last night online for the first payment. No Ejari was registered as yet Can I pull out as the cheques were not delivered as agreed even though he offered late last night to pay the first installment online? The last online payment he made took 3 days to arrive in the account. I want to legally pull out. How do I do this and can I do it without any penalty? Does he lose his deposit and can he make a claim against me? If so, what does his legal action look like, i.e. what can he do? Regards+6

Can a tenant claim compensation if they leave early and I re-lease the apartment?
Q: Dear Lawyers, My Dubai tenant`s rental agreement is ending at the end of November 2024, and the completion of the 12-month legally served eviction notice (for reasons of personal use or sale) is at the end of March 2025. The tenant still has 9 months until the eviction notice date. However, the tenant has sent a notice stating that as per the above-mentioned eviction notice, he wants to vacate the property by giving one month`s notice, as per the tenancy agreement. I don`t have any problem with the tenant leaving as it is as per the tenancy agreement, but my question is, once the tenant leaves, can he still file a case and claim compensation if I lease the apartment to someone else within the next two years or not?
