What can I do if the tenant of my villa makes changes without my consent?
Q: I have a villa in Dubai and the rent contract between us and the tenant stipulates that the tenant can not make any modifications or changes to the villa without the owner’s written consent. I found that the tenant had made additions that can damage the structure of the villa, also he neglected the swimming pool maintenance and stopped the garden irrigation system for the garden under the pretext that he does not need the swimming pool and the garden. I spoke with him and he claimed that when he leaves the villa in the future he would repair the damage. Note that he entered the construction materials from the gate of the complex without taking the approval of the developer. I sent him a warning through the notary to remove the added structure and repair the damages within a period of thirty days, but he ignored the warning. The initial estimate of the damage is much more than his deposit with us. Please advise أسئلة وأجوبة

A tenant refuses rent increase and payment term changes: What to do?
Q: Dear Sir/Madam, I purchased a property in December 2022 and served the eviction notice on January 9, 2023. The current tenancy agreement is set to expire on June 30, 2023. I want to modify the payment terms for the new contract, effective from July 1, 2023, to January 8, 2024 (the end of the eviction notice), changing from 12 checks to 1 for the six-month period. Additionally, I intend to increase the rent by 20% as I believe the existing tenant is paying 60% less than the current market rate. The tenant refuses to accept these changes and wishes to renew the lease with no alterations. Where do I stand in this situation? RERA provides varying information each time I seek clarity.

Q: Hi Sir, I have a question regarding my employer. I worked for over 9 years in a restaurant company here in Dubai. The problem was that I submitted an immediate resignation via email without the 30 days notice period. According to them, they will deduct my 1-month salary because of that. س: مرحبًا، رُفعت ضدي دعوى مالية جنائية بسبب عدم دفع الإيجار لمالك العقار. سددتُ جميع المبالغ المستحقة التي فرضها مركز فض المنازعات الإيجارية في ديسمبر 2022 ثم أغلقت الهيئة القضية. أعتزم الآن زيارة الإمارات العربية المتحدة، فهل ستؤثر قضيتي على تأشيرة الزيارة الخاصة بي، حتى لو تمت تسويتها وحلها؟

منزل جديد غير جاهز للسكن بعد إصدار الشيكات. ماذا يفعل المستأجر؟
س: مرحبًا، وقعت عقد إيجار للانتقال إلى منزل جديد في 17 نوفمبر 2023. ذكر الملحق أن المنزل سيكون جاهزًا للانتقال إليه بعد التنظيف الدقيق وإجراء مكافحة الآفات قبل تاريخ انتقالنا. ومع ذلك، عندما زرنا العقار أمس، لم يتم الانتهاء من أي من أعمال الصيانة، ووجدنا العديد من المشكلات، مثل فقد مفاتيح، وعدم اكتمال خطافات التعليق في الحمام، وغياب غطاء الصرف، وضياع صنبور المياه الخارجي. من الواضح أن العقار لن يكون جاهزًا للانتقال إليه بحلول 17 فبراير. تحدثنا إلى السمسار لتأجيل تاريخ الانتقال وإعادة الشيكات القديمة حتى نتمكن من كتابة شيكات جديدة. للأسف، كان المالك قد أودع بالفعل 2/3 من الشيكات في البنك. نظرًا لوجود خرق محتمل للعقد بسبب عدم جاهزية العقار للانتقال إليه بحلول 17 فبراير، فما حقوقنا؟ هل يمكننا إلغاء العقد؟ هل يمكن ارتجاع الشيكات بحيث لا يحصل المالك على الأموال؟ إذا رُفضت الشيكات، هل سنتعرض لعقوبة؟2023/02/16

زيارات معاينة العقار: الحقوق والخيارات المتاحة للمستأجر
س: مرحبًا، يرغب مالك العقار في بيعه لأنه يريد الانتقال إلى بلد آخر. أصبحت زيارات المعاينة مزعجة للغاية. الوكلاء يتواصلون معي كتابةً أو يتصلون بي طوال الوقت؛ فهم يريدون المعاينة في نفس اليوم أو خلال عطلة نهاية الأسبوع. يتعين عليّ البقاء في المنزل لهذا الغرض، وأحيانًا يلغون الزيارة في اللحظة الأخيرة. ماذا أفعل حيال ذلك؟ شكرًا لك!
