Can I refuse to leave the apartment after the eviction notice if the landlord shows no intention to sell?
Q: I am reposting the question as maybe I was not clear the first time. I am a tenant in an apartment in Dubai. I stayed in the apartment for a long time. I received a valid 12-month notice from the landlord to vacate the property because they want to sell it. However, 9 months have passed since and the landlord has shown no intention of selling. I asked them about it and they said they intend to renovate it first before selling it. As I do not want to move out, can I dispute this at the RDC in any way? Q: I have been renting an apartment in Dubai for 5 years. The landlord was not happy last 3 years as they were not able to raise rent more than the RERA calculator. In 2023, they sent me an email, non-notarized, asking me to evict the property for the reason of personal use. I refused this as it did not go through court and the contract was renewed for another year. This time, in 2024, they sent a court eviction notice with a reason for sale. It was sent 12 months before the end of the contract. In the period since the notice was sent, they did not try to sell the property or list it anywhere for sale. My question is, can I dispute the notice based on the reason they do not show any intent to sell, and that I suspect they only want me out so they can re-rent it higher? أسئلة وأجوبة

Seller backed out after manually signing due to DLD website outage. What to do?
Q: Dear Lawyers, I am a Dubai resident. I found a property in Dubai to buy through a real estate agent, and the seller agreed on the price I offered. At the time of signing the Sale Contract (Form F) on the DLD website, the system was down, so we signed it manually and gave the deposit check to the agent. The contract stated that the RERA system was down and that when it is back in operation, we should refile Form F digitally within 24 hours. The next day, the agent prepared it, and I signed it, but the seller refused to. He proceeded with the sale of the property to a different buyer and refused to pay the penalty stated in the contract. My questions are: 1. Is this legal? 2. Can he sell it to someone else even though he signed a contract with me? 3. RERA couldn`t block the sale because the contract was done manually and not registered in their system. Do I have legal rights to demand the penalty be paid or for the sale to go through? How to speed up buyer’s bank account opening and claim security deposit if delayed?
Q: Dear Lawyers, I am selling an apartment in Dubai to a US-based buyer. The Form F was signed at the end of May and has been extended twice to allow the buyer to secure financing. They have received pre-approval and are now waiting for the final offer letter. To obtain the final offer letter, the buyers (husband and wife) need to travel to the UAE to open a bank account. Due to personal circumstances, they cannot travel together, which means the bank account will not be opened for at least another two weeks. The Form F is expiring in three days. What are my recourses as a seller to: a) force the buyer to expedite their travel plans to open the bank account, and b) claim their security deposit held by the agent if they do not expedite their travel? On sick leave. Can my school make me resign? What are my rights if they do?
Q: Hi, I’m a teacher in Dubai and have been given a medical note for sick leave due to mental health. I am currently still in the UK because I found boarding the plane extremely overwhelming in my state, so my sick note was issued by UK doctors. Do I need a Dubai sick note too? My school has given me the option to resign, but I don’t want to do this as I plan to return to work after receiving therapy and medication. What are my rights? I have worked at the school for a year and have a total of three years of teaching experience in Dubai. This is the first time I have ever needed medical sick leave in my entire 10-year career. What are the chances of recovering my money from a fraudulent immigration company?
Q: Good Morning, A fraudulent company committed to providing results from the AIP program in Canada. I paid approximately AED 80,000 in November 2023, and they gave me a post-dated cheque to ensure my amount. They failed to deliver the results as promised; the owner himself decided to roll back the program and proceed with a refund, but he eventually did not fulfill his commitments, even after agreeing to installments. We have been chasing him since March 2024, but he is not responding. He has nothing to say, and currently, he is not in the UAE. In this case, how can I recover my hard-earned money, which is for our children? How can I file a case? Currently, I am living in Saudi Arabia. I know there is some platform where I can raise an online complaint, but I’m not sure how long it could take to finalize the case. What are the chances of winning? Q: Good day, Sir, I have received a message from the Dubai Court stating that a bank has filed a civil case against me. The loan has been pending since February 2019. New developer wants to change payment terms. How to me to protect my rights?
Q: Dear Sir/Madam, I bought a residential property for AED 7 million in Dubai from a developer in 2013 and registered the property in the same year. The project has been delayed and is still not complete. The original developer sold/transferred the project to another developer in 2022. The project is now 60% complete as per the latest RERA inspection report. The original payment terms in the Sales Purchase Agreement were a final balance payment of 40% to be payable on the handover of the property. However, now the new developer has drafted a new Sales Purchase Agreement where he is demanding 90% to be paid in stages while construction is in progress, and only a balance of 10% to be payable on the handover of the property. The RERA website states project completion by Dec 2025. Please advise if the new developer has the legal right to change these payment terms.
