Q: Hello, My tenant`s current tenancy contract is due for renewal on 24th July 2024 (the contract period end date is 24th July 2024). However, I would like to give a 12-month eviction notice to my tenant before the end of the existing tenancy contract. Can I do it? If I give a 12-month eviction notice on 15th July 2024, the end date to be mentioned at the time of renewal of the new tenancy contract would be the end date of the 12-month eviction notice, right? Unpaid for 5 months: Should I leave immediately or file a complaint with MOHRE?
Q: Good day! I would like to seek advice regarding my situation. I am currently employed by a Freezone company under a limited contract valid until October 2024. The issue is that they haven’t paid our salaries for 5 months (since February 2024). We have been receiving monthly promises that they will pay and settle the amounts, but we haven`t received anything. I tried talking to the management and sent them emails, and they again promised that they will settle everything in 2 months. I want to know my rights and if it is possible to leave without the notice period since they are already in breach of contract. Can unpaid credit card debt lead to a travel ban in the UAE?
Q: Dear Lawyers, I have a credit card from a bank on which I used AED 20k and stopped paying 3 years ago. Now, third-party agents are approaching me to pay back, and the principal amount is AED 27k. I said that I used only 20k, so why should I pay 27k? They said it’s the minimum interest for AED 20k. I agreed to pay 15k with a down payment of 5k and the rest 10k in EMI installments, but they did not agree and are forcing me to pay 27k or a lump sum of 20k. Q: Dear Lawyers, My Dubai tenant`s rental agreement is ending at the end of November 2024, and the completion of the 12-month legally served eviction notice (for reasons of personal use or sale) is at the end of March 2025. The tenant still has 9 months until the eviction notice date. However, the tenant has sent a notice stating that as per the above-mentioned eviction notice, he wants to vacate the property by giving one month`s notice, as per the tenancy agreement. I don`t have any problem with the tenant leaving as it is as per the tenancy agreement, but my question is, once the tenant leaves, can he still file a case and claim compensation if I lease the apartment to someone else within the next two years or not? Is there a chance to waive the 3-month rent penalty for early termination due to migration?
Q: Dear Sir/Madam, I need to break my tenancy contract early as my migration has been approved, and I need to leave Dubai and move to that country soon. I have informed them at least 82 days before the date I want to vacate the premises. The contract states that I need to pay 3 months` rent as a penalty. Is this legal or is it too much? Q: Hi there! Our landlord sold the apartment we are currently staying in. We were aware they were on sale, but we never received any legal notice about it. We only received the title deed under the new owner`s name and issued the rest of the cheques to him. Can I appeal if landlord falsely claims rent non-payment despite evidence?
Q: Hi, I received a 30-day legal notice for missed rent on 26th Jan. I transferred the rent to the landlord by 7th Feb. I have communication from him that it was received. The subsequent months up until March were all paid and acknowledged by the landlord. A couple of weeks before renewal, he tried to increase the rent from 56k to 70k. On the contract renewal date, I filed an offer and renewal case, which the landlord did not respond to. On 8th May, he filed a case of First Instance stating he was still owed rent from the previous contract, which was already paid and acknowledged.
