What to do if your new employer does not provide you a visa
Q: Hello, I have been working for a company for more than 3 years, then I got selected for a new job. The new company requested me to resign and requested for the cancellation asap. They have given me the offer letter at the start which is signed by both. I manage to resign without serving my notice period so I didn`t get my gratuity and I have given them all the documents and the cancellation required for the process of my new visa. Today it`s more than one month and no visa processed yet. I have consumed all the legal days of staying in the UAE. And yesterday I called them and simply they said that they don`t have money to process my visa. Is there anything I can do about this? I was having a happy life here. Now I lost my job and I have no more time to stay, I start to have penalties for my staying in Dubai.

كيف يمكنني الاستعلام وإزالة المنع من دائرة الهجرة الإماراتية؟
س: كيف يمكنني الاستعلام عن نوع المنع المطبق ضدي؟ أنا رجل أعمال، وكنت أسافر إلى دبي لأغراض العمل والتجارة. كانت لدي تأشيرة إقامة لمدة طويلة. ولكن عندما سافرت إلى دبي في عام 2014 تم اقتيادي من دائرة الهجرة بمطار دبي الدولي إلى سجن العوير المركزي. قاموا بأخذ بصمات أصابعي وبصمة القرنية. أخبروني أن أتصل بمديري، ولكن لسوء الحظ كان مديري خارج الإمارات. قاموا بعدها بترحيلي إلى بلدي دون إخباري بأي شيء. أريد الآن أن أعرف إذا كان هناك منعًا ضدي أم لا. وإذا كان هناك منعًا ضدي، فكيف أستعلم منذ متى تم منعي؟ وكيف أرفع المنع المطبق ضدي؟2017/09/22

كيف أحصل على خطاب عدم ممانعة من كفيل لا يرد على مكالماتي ورسائلي
س: سيدي العزيز، قام صاحب العمل السابق بالتقدم بطلب رخصة HAAD للشركة الكفيلة. وبعد إصدار الرخصة، توقف صاحب العمل عن الرد على مكالماتي ورسائلي الإلكترونية، ولم أحصل على التأشيرة أو تصريح الدخول وبالتالي لم أنضم إلى الشركة. والآن حصلت على وظيفة جديدة، وطلب مني صاحب العمل الجديد خطاب عدم ممانعة من صاحب العمل السابق لأجل تحويل الرخصة. لكن صاحب العمل السابق لا يرد على مكالماتي. ماذا أفعل الآن؟ هل يمكنني تحويل الرخصة لكفيل آخر دون خطاب عدم ممانعة؟ وإذا كان لابد من إحضار ذلك الخطاب على الرغم من أنني لم أدخل الإمارات ولم أعمل بها، فماذا أفعل؟ شكرًا مقدمًا على مساعدتك.2017/09/20

مطالبة البنك بالرسوم السنوية للبطاقة الائتمانية بعد مغادرتي للإمارات
س: غادرت الإمارات في أكتوبر 2015 ونسيت إلغاء بطاقتي الإئتمانية. وفي إبريل 2016، وباستخدام حسابي الإلكتروني، طلبت من البنك إلغاء البطاقة بما أنني لم أكن مدينًا بأي مبلغ للبنك لا وقت مغادرتي للإمارات ولا وقت طلب الإلغاء. لكن لم يقم بنك أبو ظبي الإسلامي بإلغاء البطاقة وفرض عليّ رسوم سنوية في نوفمبر 2016. وفي سبتمبر 2017، تلقيت رسالة إلكترونية من مكتب تراست لتحصيل الديون مفادها أنهم المستشار القانوني للبنك وأنني مدين للبنك بمبلغ 1003 درهم. وفي وقت التجديد، لم يكن لدي تأشيرة صالحة ولا بطاقة هوية إماراتية. والآن، يجملي البنك مسؤولية دفع ذلك المبلغ، ولا يردون على رسائلي ولا أستطيع الاتصال بهم لأنني في الهند. ماذا أفعل؟ أحتاج لمساعدتك.2017/09/19

Insurance policy cancellation for defaulting on contributions
Q: I took insurance policies with a reputable company. There is initial contribution period of 2 years, wherein you cannot withdraw or touch your own money. Both policies started around April 2014 and I paid diligently until October 2015. The monthly contribution is around AED 2100 per month. I stopped the other plan briefly then continued to pay until around April 2016. Because of more financial difficulties, I was not able to pay my monthly contribution starting April 2016. My financial adviser said that my money is still there until maturity. When I checked again, my policy is gone along with my contribution. The call centre agent said it went to the charges. I have another plan, which is also untouchable at the moment. The financial adviser did not tell me anything about it. I want to complain about the insurance company, as well as the broker where my financial adviser works. Is there any legal way to recover that money? I hope you can help me.2017/09/19

Deductions from the security deposit upon termination of Lease Agreement
Q: Hi, Rocky Real Estate is deducting painting and cleaning charges by mentioning the clause number 6 of the agreement signed between me and them. Clause number 6 says if the tenant vacates the flat before 3 years than the tenant has to pay painting and cleaning charges. Howsoever landlord has not given the 2nd-year contract to Rocky and they itself has not managed the building for 3 years, so is clause number 6 void or not? They still hold the property till 19th Sep 2017 and I have not handed till now to them. Please suggest appropriate action. I cant let them play with my hard earned money.2017/09/19

هل سيتم منعي من السفر في الإمارات بسبب قرض بنكي في السعودية؟
س: طاب يومك! أقيم في الإمارات العربية المتحدة حاليًا. مديون بقرض بنكي في السعودية يرجع إلى العام 2014 لم أقم بسداده. حاليًا تقوم وكالة "بلكيش "، وهي وكالة لتحصيل الديون، بالاتصال بي باستمرار لدفع الدين في خلال أيام فقط. لا أستطيع السداد فورًا حيث أنني لا أكسب الكثير. ممثلة من الوكالة تقول أنها سوف تسعى للتأكد من أن البنك سيطلب منعي من السفر هنا في الإمارات العربية المتحدة. هل تملك وكالة التحصيل الحق في منعي من الهجرة أو وضعي على قائمة المنع من السفر هنا في الإمارات؟ شكرًا جزيلًا لك لردك.2017/09/19

Liability of Finance Manager for bank loans of the company
Q: My ex-colleague was an employee in a Sharjah Hamriya Free Zone entity owned by an Indian expatriate. During his tenure as Finance Manager, he was a co-signatory to bank cheques. He has not signed any guarantee cheques or loan agreements with banks except as a witness to the document signed between the bank and the owner. He has resigned in Dec 2015 and since then the owner of the business has run away from the UAE. Now my colleague is under threat from the banks which have provided banking lines to the entity that he will be sued as he was also responsible as Finance Manager of the entity. Want to know can the banks include my colleague as a party to the case? If yes, what would be my colleague`s liability? Can the bank file a criminal case & enforce a travel ban on my colleague?2017/09/19
