Visa and offer letter
Q: Hello, my friend works at the clinic. Her employer (doctor of the clinic) sent her offer, and she signed it, but she never signed the agreement. The initial deal was that she gets a visa then license for beauty therapist. The doctor was forcing her to do procedures without the license, on top sexually harassed her by touching and sending some texts over whatsapp. She wants to quit the job as she is under stress and not willing to work in that environment. Now the doctor says she has to cover all costs for visa etc. Is there a way to avoid that? What are her rights and what she has to do? Pls advise.

Recovery of end of service benefits
Q: I worked for a DIFC company for a year. The company went into liquidation and since that time (2009) I was not able to get my end of service benefits (AED 60,000). I am contacting the liquidator, sending emails every now and then, but most of the time no answer or the same answer "There is no update, we are trying to sell the company assets. We will update you soon..." How can I recover that money? Please advise.2017/01/18

س: مرحبًا، لقد كنت في زيارة إلى دبي في سبتمبر 2016، حصلت على وظيفة، وقام صاحب العمل الخاص بي بالتقديم على تأشيرة العمل لي في أكتوبر 2016. وعلى الرغم من كوني وسيط عقاري، وهو ما كتب في عرض العمل، فإنه عند توقيع عقد العمل قاموا بوضع تأشيرتي تحت مسمى موظف أرشيف لكي يتجنبوا مصاريف شهادة مؤسسة التنظيم العقاري. كانت الشركة تخبرني أيضًا أن أبيع منتجات مالية ليس لدي أي خبرة فيها، لذا فقد استقلت وغادرت إلى الهند حيث أن تأشيرة السياحة الخاصة بي كانت على وشك الانتهاء، وشركتي السابقة غير مستعدة لكي تلغي تأشيرتي. هل هذا يضع بصورة آلية منعًا من العمل ضدي لمدة 6 أشهر؟ وهل سوف يؤثر هذا على حصولي على تأشيرة زيارة لأختي المقيمة في دبي؟ برجاء ملاحظة أنني لم أدخل الإمارات بناءً على تأشيرتهم، وقد انتهت تأشيرتهم في 17 ديسمبر 2016.2017/02/02

Early termination of limited employment contract
Q: Hi. I am employed by a DMCC company with a limited contract. I have finished 1 year 3 months to the company and decided to leave. As this is a small company wherein operated by just me and my boss, he doesn`t want to release me till we found a replacement. I am serving my 30 days notice period till 21 of this month and on process of finding a replacement (interviews ongoing). My question is if he wasn`t able to find a replacement till 21 of this month, does he have the right to force me to extend my service? He keeps on threatening me that he will file a case and make a problem for me in mediation and labour. Please help. I am willing to pay the 45 days early termination fine. I just want to leave the company. :(

س: سيدي العزيز، أنا في الهند. وصلني خطاب عرض وظيفة من شركة بالإمارات وقمت بتوقيعه.بعد ذلك علمت أن هذه الشركة تعذب العاملين بها ولا تدفع لهم الرواتب في مواعيدها. أنا خائف. منذ أسبوع، أرسلت لي الشركة رسالة إلكترونية تطلب مني توقيع "الإصدار المسبق لتصريح العمل" لكنني لم أرد بعد. هل سيتم حظري من العمل بالإمارات إذا لم أوقّع؟ وهل يمكنهم إصدار تأشيرة لي دون توقيعي؟ أرجو المساعدة.2017/01/19

ماذا أفعل إذا قام صاحب العمل بتأجيل إصدار تأشيرتي؟
س: سيدي العزيز، أنا طبيب أسنان متخصص في اللبية من الهند. تلقيت خطاب عرض في يوم 29 يوليو 2016، وتم إصدار رخصة هيئة الصحة بأبو ظبي بصفتي طبيب أسنان يوم 14 أكتوبر 2016. بعد ذلك، تواصلت مع صاحب العمل بشأن تأشيرة العمل لكنه بدأ يقدم لي أعذارًا في كل مرة. واليوم 23 يناير 2017، ولم أتلقى ردًا رسميًا من صاحب العمل بشأن التأشيرة حتى الآن. كيف يمكنني الخروج من هذا الموقف؟ وما هي الإجراءات القانونية التي يمكن اتخاذها لدفع صاحب العمل إلى إصدار تأشيرة عمل لي أو لأن يدعني أبحث عن وظيفة أخرى دون حظري من العمل؟ أرجو المساعدة.2017/01/23

Sale of a jointly owned apartment in Dubai
Q: I have the following legal situation with which I would like to seek an advice and potential representation. The facts are as following: myself, my sister and our mother own 75% of shares in an apartment in Dubai. The remaining 25% owns our father, ex-husband of our mother. They recently got divorced in Russia. We are all citizens of Russian Federation. Now we want to sell the apartment, but our father refuses to sell his share of ownership so that to make it impossible for us to receive any income from this apartment. Russian court decided that after divorce each party (mother and father) keeps his/her 25% of ownership. What possible legal options we have in order to be able to sell this apartment? Health insurance claim
Q: Dears, I have a health insurance claim of 50K AED that was rejected by the insurance company because they think it is a pre-existing condition. The health issue was a heart attack that occurred for the first time so it is not a pre-existing condition. I would like to make an appeal on that rejection. Hiring freelancers for an online business
Q: To whom this may concern, I am a Canadian citizen living in Al Ain city in the United Arab Emirates. I am currently thinking of starting an online business similar to "Talabat.com" if you know it except it will not be a food service. I have some people in mind that can work with me as freelancers but at the same time, I am wondering what are the rules to follow as an expat regarding this issue. دعوى مدنية للمطالبة بقيمة شيك مرتجع
س: قام شخص بتحرير شيكًا مرتجعًا لي بمبلغ كبير من المال. بعد ذلك، قمت بالتقدم بشكوى لدى الشرطة ثم أحيل الأمر إلى المحكمة، وحكم القاضي يوم 24 يناير وتم حبس المتهم. لكن الحكم لا يقضي بإجبار المتهم على دفع المبلغ. أعتقد أن بإمكاني رفع دعوى مدنية ضد المتهم لتحصيل المبلغ، لكنني لا أعرف ما إذا كان هذا صحيحًا ولا أعرف الإجراءات التي ينبغي اتخاذها. أقدر مشورتك كثيرًا.2017/02/01
