Overcrowded flat eviction and claim of the security deposit
Q: Hi. I am staying at Jumeirah Lake Towers, and it is one of the overcrowded flats. After the rule came from DMCC, we cannot stay in an overcrowded flat. However, my landlord is not ready to refund my deposit now, and every month comes and takes the advance rent from us. We are in a trap and not able to leave the flat. Please guide me how can I highlight it to the DMCC, and what would be the impact on us in that case? He is asking us to leave the deposit and leave. Although I have given him notice of 20 days he is not to consider that, and asking to give one month notice starting from the 1st of every month2017/09/19

Claiming your passport from the public prosecution after bailing a friend
Q: Hi. I kept my passport as a guarantee for a friend in the public prosecution more than a year back. He left the country without telling me and hasn`t come back into the country so far. In the meantime, verdicts were declared for his cases and he has to go to jail. So, he refuses to come back or settle the case. I am stuck here with my passport in court. I have tried setting up meetings with the public prosecutor but every time the online application gets rejected, even for a meeting with the public prosecutor. This has created a big issue for me and my family. Is there anything I can do to get my passport out?

Debt claim from an absconding employee
Q: Good Afternoon, Sir, We are a Dubai-based company, and we would like to know what to do regarding our outstanding pending amount with one of our old staff. We have to get AED 226,600 from him and already filed a bounced cheque case at Dubai Police regarding our sales amount. Dismissal of an employee for unsatisfactory performance
Q: The company I have worked at for over 3 years terminated my contract alleging that the company forecast is not famous, as the clients are not awarding us new jobs. The reason is not related to my work nor my performance. Never had any negative feedback nor complaints whatsoever from the company. طلب صاحب العمل لتوقيع خطاب تخليص للمستحقات غير المدفوعة بعد إنهاء العقد
س: عملت كمدير مشروعات لشركة لمدة 9 سنوات، لكن الشركة قامت بإنهاء خدمتي منذ 45 يومًا (لأن العمل قد أصبح أقل والشركة تريد خفض العمالة). لا أمانع العودة إلى بلدي، لكن الشركة تتوقع مني توقيع خطاب بالعربية مفاده أنني حصلت على جميع مستحقاتي حتى يوافقوا على إلغاء التأشيرة التي ستنتهي يوم 7-10-2017. وبما أن الوضع المالي للشركة سيئًا، فلن تتمكن الشركة من دفع مكافأة نهاية الخدمة والتعويضات الأخرى لي، ولم يعطونني تاريخًا واضحًا لتسديد مستحقاتي. أنا خائف من أنني إذا وقعت الخطاب وتم إلغاء تأشيرتي، لن أتمكن من المكث في الإمارات لأكثر من 28 يومًا. لا أرغب في ملاحقة الشركة قانونيًا، لكن في الوقت ذاته، أنا قلق من احتمالية إنكار الشركة لمستحقاتي إذا وقعت الخطاب وغادرت الإمارات. ماذا أفعل؟

شركة تطلب مني دفع تكاليف التأشيرة. هل هذا قانوني؟
س: تلقيت عرضًا وظيفيًا من شركة بالإمارات، لكن أخبروني أن عليّ دفع تكاليف التأشيرة كتأمين ثم يردونها لي بعد ستة أشهر. سوف ترسل لي الشركة خطاب عرض توظيفي وسوف يتوجب عليّ دفع تكاليف التأشيرة في الوقت ذاته. لست واثقًا من أن خطاب العرض يعد وثيقة ملزمة قانونيًا أستطيع استخدامها في المستقبل إذا لم توفر لي تلك الشركة وظيفة. أرجو منك مساعدتي. أنا في دبي حاليًا بتأشيرة زيارة.2017/09/18

Early termination of lease agreement to a commercial property
Q: Back in April, I had signed for an office space in order to start registering my business. However, due to my investor backing out immediately afterwards, I had to halt my plans and cancel the office space. However, the office space management refused to cancel the lease as the contract has a clause stating that in the event of cancellation of the contract, I am still liable to pay the entire amount of the rent, regardless of not having used the office space at all. They continued to make invoices and are threatening with legal action if I do not pay. I would like some advice on how to handle this situation as I do not have the funds necessary to pay off an office space for one year. I feel it is unfair that they should force me to pay for an office I have not used nor planned on using, having informed them of this within a month of the contract being signed.2017/09/18
