Refund of a deposit paid by the buyer of a real estate property
Q: Hi, I had signed an MOU to buy an apartment. I had the following clause in the MOU: "This sale purchase contract is subject to the final approval from the Buyers Banks" My mortgage has been rejected by one bank. While I was processing my mortgage with another bank the MOU expired and the seller is not willing to extend the MOU. Can I claim my deposit check back from the agent? Thanks, Dinesh

Dishonoured cheques and breach of contract
Q: A Company had issued us several cheques amounting to nearly 600,000 AED. All the cheques had bounced, and we lodged a complaint with the police station. The police after calling for the bank documents and details from the defaulter`s bank issued a travel ban. All efforts of the police to trace the defaulter or contact over the phone have been futile. The police have now forwarded the case to the court and asked me to keep track of the dates on the portal. The cheques were signed by the Managing Director of the company. It is important to note that the defaulting Company had violated several terms in the contract, resulting in fraud and criminal conspiracy and breach of trust. Please advise what will be the consequences the defaulter may have to face and how should we go about it.

What to do if you have a police case due to an unpaid bank loan
Q: Hello Sirs, I badly need help. I was terminated from work due to a bad market situation to cut the cost. They let me use the company visa until I get a permanent job but the market situation is really bad. They informed me that the management has decided to cancel all pending visas of terminated people including mine. When my passport and documents were submitted to JAFZA, the cancellation was rejected due to a police case due to non-payment of a bank loan. I am so afraid they will catch me and put me directly in jail... If so, how can I start again and look for a new job to repay my loans? Please, I beg you help me... Do I need to cancel visa with my employer in Kuwait to get UAE employment visa?
Q: I was working in Kuwait as an electrical QC inspector. While working in Kuwait I got an offer from an Abu Dhabi company for ADCO project. They told me that I have to come to India for joining ADCO project in Abu Dhabi. Then, I moved to India and I received an offer letter from Abu Dhabi company. They offered me almost 5600 AED/month. I accepted the offer letter and put my thumb impression and signature on offer letter and sent it to my employer in Abu Dhabi. They told me that they are going to apply for a visa for me. But today they called me that my visa application rejected. They told me that it`s rejected perhaps of my active visa in Kuwait because I didn`t cancel visa of my previous employer but my visa is going to be expired in next month on 24th August. Can you tell me the reason for my visa rejection and what should I do? Thanks2017/07/17

Filing case for maintenance against husband in the UAE
Q: Dear, I am writing this on behalf of my sister in law: "I married this guy almost 15 years ago. He left for a job in the UAE. Now he rarely visits me in Pakistan in years. He also got married to some other Pakistani girl in the UAE. Meanwhile, he is forcing me to live in Pakistan in his own home and does not directly give me the money to take care of myself and my children. He sends the amount to his father and he then assesses my needs and gives me a calculated amount. Is there any law in the UAE through which I can bind him to pay me my expenses or I can take khulaa (separation)?" P.S. The lady is really heartbroken and desperate. Can I join new company while having a labour dispute with my current employer?
Q: Dear Sir, I was working in a construction company as IT Engineer. I have Salary dispute with my company for 1 year and that company closed after 2 months from my complaint date in MOL. They opened another company in Umm Al Quwain. Court also gave the decision in my favour but I still have not received my money. On the last visit in court, they said me to type application from typing centre for Guarantee Cheque. I did it on the same day, then they said to come after 1 month, but still I dont know if I will receive my money or not. I have another job offer. Setting up an online drop shipping business
Q: Hello, I want to start a drop shipping business (expecting to make less than a thousand Jordanian Dinar a year). Basically, drop shipping is selling a product on an online store without owning the product or having to keep inventory. When I get a sale I go and buy it from Ali Express (which is a website full of suppliers from China) and I ship the product to a customer address (in United States) and earn the difference in money. So my question is: In Jordan do I have to pay taxes and do I need to register a company because I am making a profit, and is there a limit that I should be making before setting up a company? And what happens if I continue without setting up a company? Thank you for your time.

Conflict within a family
Q: I am UAE national living in Ras al Khaimah 29 years old female. I have graduated in 2005 and because of my mom health I could not work or study as I kept travelling with mom for her treatment. Last year mom passed away and I came back with my brother. He insults me and forces me to work as a servant at home. No phone, no job and even shoun that government gives me, he took all that month. He said no shoun had come last month. I know there is shoun, he bought a phone for me just to not araise complaint against him. I want to do a job, he refused. How to evict a tenant who committed default on payments
Q: Hi, my tenant is a company and has not paid the rent for past two months. I have filed a police complaint and eviction notice from the court. He keeps on saying he will pay every week but does not honour his deadlines. كيف يمكنني رفع حظر العمل في الإمارات
س: كنت أعمل في شركة بوتيك 1، شركة ذات مسؤولية محدودة. تركت الشركة في شهر أكتوبر من العام 2015 بعد العمل معهم لمدة 11 شهرًا، لذا حصلت على حظر عمل لمدة سنة. ثم التحقت بشركة أخرى في المنطقة الحرة، وتمت إجراءات تأشيرتي بدون مواجهة أي مشاكل في أكتوبر 2015. إنني الآن مع هذه الشركة منذ سنة وتسعة أشهر، والآن لدي عرض عمل من شركة لاندمارك، كمدير للتسويق بالشركة، وهي شركة ذات مسؤولية محدودة. لذلك قمت بإلغاء تأشيرتي وقدمت على تأشيرة جديدة معهم، ولكن تم الرفض بسبب أنه لدي منع عمل لمدة سنة. وُضع الحظر من العمل من قبل جهة العمل القديمة بوتيك 1 ( كان يجب أن ينتهي المنع من العمل السنة الماضية)، ولكن نظرًا لأنني لم أغادر البلد وغيرت التأشيرة الخاصة بي من داخل الإمارات، فإن منع العمل لم يبدأ من الأساس. لقد قدمت طلبًا في "تسهيل"، ولكني لا أعتقد أن ذلك سيساعد في شيء. لدي كل ما يلزم لرفع هذا الحظر. عقد العمل براتب يزيد كثيرًا عن 12000 درهم إماراتي، شهادة موثقة بدرجة البكالوريوس، وإذا لزم الأمر، يمكنني الحصول على شهادة عدم ممانعة من بوتيك 1، حيث قد مرت سنتين تقريبًا منذ أن تركتهم. أريد المساعدة العاجلة.2017/07/12

Bank dues and arrest at the airport
Q: Dear Nikhat, I have a personal loan with a bank in Dubai. Last October 2016 I lost my job and the company sent me back to my country. Now I have a job offer and visa. Will I be arrested if I arrive in the UAE? Due to the job lost only I didn`t pay the amount. If possible I can speak to the bank and I can pay the amount monthly. Please advise me. Thanks / Regards
