كيف يمكن الاعتراض على الترحيل غير القانوني بدون أي تفسير في الإمارات العربية المتحدة؟
س: أبحث عن محامٍ لدعوى ترحيل خاطئ، مخالفًا لدستور دولة الإمارات العربية المتحدة "الباب الثالث: الحريات والحقوق والواجبات العامة"، المواد ٢٥ و٢٦ و٢٧ و٢٨. كانت الضحية مقيمة في دبي، وتحمل بطاقة هوية إماراتية صلاحيتها سارية لمدة عامين. في أحد أيام الظهيرة، اقتحم ثلاثة ضباط شرطة، لا يرتدون الزي الرسمي، باب شقتها الأمامي بدون إثبات هوية. وبعد دخولهم، فتشوا الشقة بدون إبداء أي تفسير. أبرزت المقيمتان أوراقًا قانونية، بما في ذلك بطاقة هوية إماراتية، وتصاريح عمل، وعقد إيجار الشقة. لم يُعثر على أي شيء، وطُلب من المقيمات مرافقة الضباط إلى حافلة مع نساء أخريات. في مقر إدارة التحقيقات الجنائية، لم يُقدم للضحية أي تفسير، ورُفض طلب الاستعانة بمحامٍ، أو الاتصال بسفارة بلدها. اقتيدوا تحت الإكراه إلى غرفة خاصة، والتقطت لهم صور وخضعوا للمسح الضوئي للعين، ثم أُجبروا على توقيع أوراق باللغة العربية بدون ترجمة. احتُجزت الضحية لمدة أسبوعين، ثم رُحِّلت بدون إبداء أي تفسير. كيف يمكن الطعن في هذه القضية والعودة إلى دبي؟

Late fees and plot area discrepancy. What to do?
Q: Good evening, I purchased my off-plan property in 2017 and paid only 5% of the total value. After 6 months, I informed the developer via email that I no longer wish to continue with the purchase. However, on 16/2/2023, I received a notification from the Dubai Land Department stating that I must settle my outstanding payments within one month. My question to you is whether I am eligible to pay any late penalty fees, considering that the developer failed to complete the project on time. Additionally, on my SPA, the plot area was stated as 3509 sq. ft, but upon measuring it, I found that it was actually less than 2400 sq. ft. At the time of purchase, they charged an extra 200,000 AED, and are now counting late payment penalties at a rate of 1.5% per month. Given these circumstances, what should I do? Can you guide me? رفعت زوجتي علي دعوى نفقة في الإمارات وأنا في فلسطين. ماذا أفعل؟
س: السلام عليكم، أنا أقطن الآن في بلدي فلسطين ورفعت زوجتي علي دعوى نفقة بمبالغ تقدر شهريًا ما يقارب 24 ألف درهم مع أن دخلي الشهري 8000 درهم و لدي تمويل شخصي وسيارة شهريًا يخصم 4000. كانت هناك الجلسة الأولى عبر الأونلاين وحكم القاضي بتأجيل الجلسة للصلح بعد حوالي أسبوع من الآن، خلال الجلسة شرحت للقاضي عن أسباب الخلاف حيث أن أخت زوجتي وأخوها ووالدها كانوا يقنطون عندي في نفس المنزل وطلبت منها بأن يذهبوا إلى إخوانها للعيش هناك في الإمارات نفسها. فحدث شجار وجلبت لي الشرطة وطردتني من المنزل علمًا بأن المنزل باسمها. سافرت لوحدي إلى فلسطين ورفعت عليها في بلدي دعوى طاعة ودعوى ضم أولاد حيث حسب القانون الفلسطيني يحق لي حضانتهم. الآن ليس لدي المقدرة المالية على توكيل محامي في الإمارات وحضور الجلسة القادمة للجواب على الدعوى. ماذا بمقدوري أن أصنع في هذه الحالة؟

Q: Hello, I have had an outstanding loan in the UAE since 2016 and left the UAE. I was in negotiations with several debt collectors. I paid a part back but there is still a part open. I am willing to pay the loan back or let`s say a waived part of it. But the way of communication with the debt collectors was very unprofessional. How can I claim my labor rights after being forced to resign if I left the UAE?
Q: I worked as a Graphic Designer at a document-clearing service provider company three months ago. During my employment, I was not paid for more than a month. When I inquired about the payment, my employer shouted at me and canceled my work permit on the same day without any notice. Additionally, she sent a fake email from my official email account to herself apologizing for some unlawful act. She called me to come and sort out my remaining dues, but instead, she misguided me to physically resign, which was a big mistake on my part as an employee. Now, I would like to know what documentary evidence is required to file a complaint. I look forward to your prompt response. I have all emails and other correspondences except the resignation copy I submitted physically. Is it possible to complain while outside the UAE because as per policy, I had to exit the UAE in order to change my status? I also kept snapshots of WhatsApp when she was harassing me.2023/03/14

We are late for rent in a hotel apartment. Is it legal to deposit a cheque for a higher value?
Q: We live in a hotel apartment in Bur Dubai which is closing down on March 31, 2023. We have always paid our rent on time. However, we have dues of AED 22147.27 as of the date and they have an undated cheque of AED 28936 with them from us. We promised them we will clear the dues between the 15th and 18th of this month, maximum by the 20th, and leave. They are insisting on depositing the cheque by this evening even though for a higher amount and threatening further action. Our questions: 1. Can they deposit a higher value cheque when the dues are much lesser? 2. What is the action open to them - can they evict us and if so, how soon? 3. We will clear the dues between the 15th and 18th, maximum by March 20, 2023, and they are not listening to the same. If we clear these dues and give our commitment in writing, can they still enforce action today/tomorrow? Kindly advise.
