Q: Hi, An employee resigns during the probation period in the private sector of education, and the two weeks notice period has been served. 1. How long can the employee remain in the country to find another job? Does the employee need to leave the country for three months and then return? 2. Can the employee change the visa status to tourist with a border run and stay in the UAE to find a job? Thank you

Do I need to give a new eviction notice to the tenant after purchasing an apartment?
Q: Hello, I am about to buy a rented apartment in Dubai. The current owner issued an eviction notice to the tenant around 9 months ago, giving them 12 months to leave the property. The reason mentioned in the notice is to sell the apartment. If I buy the apartment now, does the eviction notice transfer to me and the tenant will be forced to leave on the same date? Or do I need to issue another eviction notice to the tenant, giving them another 12 months to leave? Thanks! J. Q.

Can the ex-employer post a warning about you in newspaper after one year of leaving?
Q: I was working for a company for more than 20 years and last January 2022 was my last working day. After leaving the company for more than a year, can my old company publish a notice in the newspaper now saying that I don`t work for them? There was no financial fraud or any issues while leaving the company.

Can the landlord notify the tenant of his intention not to renew the contract 90 days before expiry?
Q: Dear All, Our landlord`s manager has just sent us a message via Whatsapp that they will not be renewing our current contract which expires in 90 days. I just wanted to know, does this not constitute an eviction notice which I believe needs to be sent a full year in advance, and to be sent too by registered mail? Also, in this case, does a WhatsApp message carry weight as legal notice or do they have to send it by registered mail? What other rights as a tenant do I have in this case?2023/03/01

What can I do if the landlord does not sell the property after the 12-month eviction notice?
Q: Dear Lawyers I am a tenant. I have received a legal, notarised, 12-month eviction notice stating that my landlord wishes to sell his villa. I received no calls from any agents for any viewings for some time and no viewings done to date. What if the current owner does not sell the villa by the 12-month notice period? Do I have the right to remain in the villa? Should the owner prove the sale with a valid sale MoU/title deed transfer certificate? I have to renew my lease as it expires before the 12-month notice date so do I renew for 12 months or up to the eviction notice date? Please help2023/03/01

Can a non-Muslim father claim the custody of his child as per the new personal status law?
Q: Hello, I would love to understand the new child custody laws in-depth for non-Muslim residents. My wife was granted our child`s custody in the judgment of the first instance court but I have appealed against it. Having said that, I have a family here in Dubai to support raising my son whereas my wife has only herself (she is currently employed) and has a nanny only. How can I get full custody of our son or maybe apply for joint custody as per the new law?

Will I go to jail in my home country if I do not settle the amount of a personal loan?
Q: I found out that I have a cheque execution case in Dubai court. I was even surprised because I haven`t received any message from Dubai Police, there`s no case that`s been filed under my name. Due to the pandemic, I lost my job and came back to my home country. I used to work in a bank, I had CC and a personal loan. Last year, the amount that I need to pay to them was AED 60k including the interest. And now with the case, they`re demanding I pay 138k. I`m scared to go to jail especially since I have 4 kids, and a father who will go for another heart operation. What do I do? Is there any way I can reduce the amount? I went to Dubai Courts to seek some help but she told me that they can`t do anything and that I need to pay the full amount.

Can I win against my employer for unpaid benefits?
Q: Greetings Sir, I have filed in claims complaint against my employer who has refused to pay my annual leave, 1 year and 5 months of working services including calculated overtime working for 12 hours every day and for depriving me of my 4 weekly off days every month. Due to the level of racism and deprivation of employees` legal rights, I made a complaint to the ministry of human resources and Emiratization after my employer failed to accept and sign the resignation notice letter given to him. After serving a notice period of 1 month the complaint was approved by the ministry for contract termination through Immigration. So he was contacted to pay me my benefits for the period of service rendered including my leave payment, but he refused so the case was filed in court. I want to know my stance on winning. It`s a private company.

How to remove the cases and travel ban I have in the UAE to avoid problems in GCC?
