Which labor law applies to a resigned employee who still was on an unlimited contract?
Q: If an employee has resigned within 3 years and his contract has not been converted to a limited contract, what would be the gratuity to be paid? The date of Joining is 1/1/21, and the last day of service is 31/12/23. The basic salary is 10,000. Will it be as per the New Labour Law or can we pay them as per the Old Law as mentioned in Article 68 of the new law which reads as below: "Subject to the provision of Clause (2) of this Article, the employer may calculate the end of service benefits in accordance with the provisions of the employment contract with an undefined term stated in Federal Law No. (8) of 1980 indicated above."2023/11/17

Can I take legal action and remove absconding for termination during probation?
Q: I came to the UAE on a visit visa on September 14, 2023. Then on October 11, I went for an interview. On October 12, the company offered me the job and signed the offer letter. I will start working on November 1. After that, they asked for my visa copy on November 7 and I sent it. Then on November 9, they asked for my passport-size photos for my job visa. Exactly on November 14th, the day my visit visa expired, the HR manager fired me from the job because my performance was not good enough. It`s been exactly one month since I signed the offer letter. I`m waiting for the job visa and I trusted them but they fired me before my visa expired. They gave me part of my salary for the 12 days I worked. Because of their mistake, I am absconding now. I need to renew my visa. Can you help me to remove it? I need to renew my visa soon. I am collecting fines. Help me. Can I take legal action for the injustice done to me? I have all the proofs. Q: Dear Sir/Madam, I issued an eviction notice to the tenant to sell the house. At the same time, I obtained a rent valuation certificate from the Dubai Land Department (DLD). The seller has been slow in settling his outstanding payments with the developer.
