Terminated in a freezone company. Is unused leave included in final settlement?
Q: Dear Sir/Madam, My employment in a UAE Freezone company is being terminated on Feb 29. I have 16 days of unused annual leave from 2023, 5 of which were carried over to 2024 according to company policy. Since my termination is due to cost-cutting by the company, they are compensating me for the 5 days carried over and this year`s leaves. My question is: Am I entitled to the 11 days that I worked in 2023, and should those leaves be cashed and included in my final settlement?

What does deferred to pleading mean after the case was set for judgement?
Q: What does it mean if the day after judgment is supposed to be set, the status of the case goes back to “deferred to pleading” despite no new memo or evidence being submitted by either party? A new session has been set for next week. Why was the judgment not made?

Unpaid service charges in shared ownership: Who bears responsibility?
Q: Dear Sir/Madam, I am a 50% owner of a leasehold property. The lease agreement does not specify joint or several liability. It only mentions "xxxx and yyyy" as the lessees. We have not paid service charges for the last 3 years. The other co-owner left the house 3 years ago and ceased all communications with me. The co-owner is uncontactable. The management company initiated an RDC execution case against me and my co-owner. Am I liable only for 50% of the total due amount? Or am I liable for 100% of the due amount? Can you please inform the correct article of law that covers this issue?

Is the landlord's claim true that the court must sign the deposit cheque so he can return it to me?
Q: Dear Sir/Madam, I recently moved from my old premises to a new one because the landlord wanted the tenants out after an inheritance case as he wants to increase the rent in the building. That case made the renewal of the contract impossible for months but once settled, I paid the amount in one go so I could move out. In order to avoid any issue, I moved out but the landlord is taking time to give me back my deposit telling me that some agent from the justice needs to sign the deposit cheque in order for him to give it to us. Therefore I wanted to inquire if that is true as I`m struggling now financially and that cheque would help me big time. I paid for moving out and moving in, in one go, which caused me a lot of expenses at once and that deposit cheque is more than needed. I gave them time, as they told me it needs 15 days, now it`s been 22 days and they`re still telling me the court agent did not come to sign the cheque. Could you please advise what is the legal action that I can take?2024/02/20

How can an employee who is mistreated get deported back home?
Q: Good day, I have a sister who is African, and she got a job at a ranch. They made her sign a form stating that she received a loan from the employer. Now, she is being mistreated, overworked, and underpaid. They are threatening that she can`t leave and will never be allowed to until her contract is finished. She does not have any money to repay the loan or even pay for her flights back home. Is there a way that she can be deported back home?

The new landlord is requesting changes and a new deposit. What to do?
Q: Dear Sir/Madam, My landlord renewed the contract with me just a couple of weeks before expiry and collected a single cheque out of the 2 agreed upon. However, after 1 month, he sold the property without my knowledge. Now the new landlord is asking me to sign a contract with him as the previous one is not valid since he is the new landlord. Additionally, the new landlord is asking me to change the terms and conditions and pay a new security deposit as the original landlord has not returned it.

Is an MOU still legally binding to parties after its expiry?
Q: Dear Sir/Madam, We are at the final stages of the process, with our MoU expiring while waiting for the NOC. All cheques have been issued and shared. In the MoU, we have a couple of additional conditions regarding the seller`s obligation to obtain the NOC and a penalty of 10% for defaulting on either side. If the seller decides not to continue with the process and not renew the MoU, does the expired one still legally cover the buyer?
