What is the process for claiming financial expenses at the Dubai Traffic Prosecution Court?

Hello,

I would kindly request some information on the process of the Dubai Traffic Prosecution Court.

Facts:

1. I am the affected party (Green) as per the police report. There is no dispute from the other driver. No other parties are involved.

2. The police advised to open a file with the Dubai Traffic Prosecution Court to claim financial expenses that occurred as the result of the accident (loss of earnings, medical expenses not covered by insurance, etc).

Questions:

1. What is the process of the Dubai Traffic Prosecution Court? Do I need to submit documents prior to the court date and if so how is this done?

2. If the other party wants to settle out of court, is it possible to withdraw the court case? How is this done?

Many thanks for your time!

Dear Questioner,

Thank you for reaching out with your questions regarding the Dubai Traffic Prosecution Court process!

I understand the urgency of your situation and am here to provide the information you need.

1. Process of the Dubai Traffic Prosecution Court:

- Filing a Claim:

To initiate your claim for financial expenses, you need to open a file with the Dubai Traffic Prosecution Court. This involves submitting a detailed report of the accident, a police report, and documentation of your financial losses (e.g., medical bills, loss of earnings).

- Document Submission:

Yes, you will need to submit relevant documents prior to the court date. This can include the police report, medical reports, bills, and any other evidence supporting your claim.

Documents can typically be submitted online through the court’s e-services portal or in person at the court's administrative office.

- Court Proceedings:

After filing, the court will schedule a hearing date. During the hearing, both parties will present their cases, and the judge will make a determination based on the evidence provided.

2. Settling Out of Court:

- Withdrawal of Court Case:

If the other party agrees to settle out of court, you can withdraw the case. This is generally done by submitting a formal request to the court, stating that both parties have reached an amicable settlement. The court will then dismiss the case upon verification of the settlement agreement.

3. Next Steps:

Dear Questioner,

The Dubai Traffic Prosecution Court handles cases related to traffic accidents and violations in Dubai. Here's an overview of the process and answers to your questions:

1. Process of Dubai Traffic Prosecution Court:

- Filing a Case:

To initiate a case, you or your legal representative will need to file a complaint with the Dubai Traffic Prosecution. This can typically be done by visiting the prosecution office in person or through an online portal, depending on the specific procedures in place.

- Documentation:

You will need to provide supporting documentation along with your complaint, such as the police report, evidence of financial expenses incurred as a result of the accident (e.g., medical bills, loss of earnings documentation), and any other relevant evidence.

- Investigation and Evaluation:

Once the complaint is filed, the prosecution will conduct an investigation into the circumstances of the accident and assess the evidence provided.

- Court Hearing:

If the prosecution determines that there is sufficient evidence to proceed with the case, a court hearing will be scheduled. You may be required to attend the hearing to present your case and provide testimony, or your legal representative can do so on your behalf.

- Judgment:

After considering the evidence and arguments presented, the court will issue a judgment, which may include an order for compensation to be paid to you if it finds in your favor.

2. Settling Out of Court:

- If the other party expresses a desire to settle the matter out of court, you can consider negotiating a settlement agreement. This typically involves reaching a mutually acceptable agreement regarding compensation for the damages and expenses incurred as a result of the accident.

- If both parties agree to settle out of court, you can request to withdraw the complaint filed with the Dubai Traffic Prosecution. This can typically be done by submitting a formal request to the prosecution office, indicating your intention to withdraw the case.

- It's important to ensure that any settlement agreement reached is documented in writing and signed by both parties to avoid any misunderstandings or disputes in the future.

It's advisable to seek legal advice from a qualified lawyer in Dubai who specializes in traffic accidents and civil litigation to guide you through the process, represent your interests effectively, and ensure that your rights are protected. They can also provide assistance with negotiating a settlement and withdrawing the case if necessary.

Thank you very much for your detailed response!

Could you please tell me if it is a requirement to have the supporting documents translated into Arabic? For example, medical reports, loss of earnings.

Thank you for your time!

In legal proceedings in the United Arab Emirates, documents submitted to the courts are typically required to be in Arabic or accompanied by Arabic translations.

This requirement ensures that all parties involved in the legal process can understand and review the content of the documents.

For supporting documents such as medical reports or loss of earning statements, it is generally advisable to have them translated into Arabic if they are to be submitted as evidence in court or as part of a legal proceeding.

This helps ensure that the documents are properly understood by the court and any other parties involved in the case.

If you have documents that are not in Arabic and need to be translated, it's important to use a qualified and certified translator who is proficient in both Arabic and the original language of the documents.

This ensures the accuracy and reliability of the translations, which is crucial for their acceptance by the courts.

Additionally, it's a good idea to consult with a legal professional in the UAE to confirm any specific requirements or procedures regarding the submission of documents in legal proceedings.

They can provide you with guidance tailored to your situation and ensure that you comply with all necessary requirements.
