Can my mother claim end-of-service benefits after 18 years as a nanny?

Hi,

I want to inquire about my mother's labour case. She served as a nanny for an Emirati family for 18 years.

When she finished her contract, they didn’t give her anything, like end-of-service benefits, unpaid annual leave, or day-off pay.

Would she be able to get anything?

Hello,

Thank you for your inquiry!

Based on what you’ve described, your mother may be entitled to end-of-service benefits, unpaid annual leave, and compensation for missed days off according to UAE Labour Law, especially after 18 years of service.

To accurately assess her case and help recover any owed amounts, we recommend booking a consultation or appointing our office to represent her. Please feel free to book an appointment through our website or contact us directly for assistance.

Best regards,

The thing is, we already filed a case, and the decision has been made. We will go to the court to confirm the verdict—whether it’s dismissed or we won the case. I will let you know.

Does she have an employment contract?

16 Jul 2025, 07:37

Now she’s on a visit visa.

What is this? I don't understand.

16 Jul 2025, 08:04

I mean we already filed the labour case and the decision has been made by the court. We are just waiting for the result. In case the labour case is dismissed, we will try to get a proper lawyer to handle the case.

Pursuant to Article 22 of Law No. 9 of 2022 regarding support workers, a one-month bonus is given for every four years.

Have you tried to contact the employer?

16 Jul 2025, 08:27

Yes, we tried, and MOHRE directed us to the court.

Hi,

Thank you for sharing the details regarding your mother’s employment as a nanny for 18 years!

Based on the information provided, she is likely entitled under UAE labor law—including the recent 2022 Domestic Workers Law—to receive end-of-service benefits, unpaid annual leave, and compensation for days off not granted.

To assist you further, it would be helpful to review any employment contracts, payment records, or other documentation your mother may have.

With this information, we can explore filing a formal complaint with the Ministry of Human Resources & Emiratisation (MOHRE) to pursue her rightful claims.

If you wish, we can schedule a consultation to discuss the case in detail and outline the best course of action. Please let me know a convenient time for you.

Best regards,

The thing is, we already filed the labour case and the court has decided. We are just waiting for the result. But I’m thinking that the case might get dismissed because her employer is a lawyer in Dubai court.

That’s why I’m thinking of getting a proper lawyer in case the case gets dismissed.

16 Jul 2025, 08:39

The case will not be dismissed only because the opposite party is a lawyer; the decision is based on the evidence and the benefits of the case.

Thank you for reaching out!

From what you've shared, your mother has a very strong legal basis to claim her entitlements under UAE Labour Law, especially considering her long service of 18 years.

Even if she was working in a domestic role such as a nanny, the UAE has clear regulations under Federal Decree-Law No. 9 of 2022 on Domestic Workers, which guarantees rights such as:

- End of service benefits (21 days' wage per year of service after the first year),

- Annual leave pay (30 days per year),

- Weekly day-off compensation (if she worked on her rest days without being granted time off or overtime pay), and

- Any unpaid salaries or entitlements.

These benefits are enforceable by law, regardless of whether the employer is a private family or a company.

Since she was not paid anything upon completion of her service, we can immediately initiate a labour complaint on her behalf with the Tadbeer / MOHRE system to claim:

- Unpaid end-of-service gratuity,

- Unpaid annual leave,

- Compensation for working on rest days, and

- Any other dues or violations (if applicable).

We will also make a demand for interest and possible compensation due to the employer’s failure to settle her dues.

I would be happy to represent her and take this matter forward with priority.

Please feel free to contact me directly on [-----------] (WhatsApp or call) so I can assess her situation in more detail and begin the process of securing her rightful dues.

Dear Questioner,

Thank you for reaching out about your mother’s situation!

Under UAE Labour Law, domestic workers like nannies are entitled to certain end-of-service benefits and payment for unused annual leave and days off once their contract ends.

Since your mother worked for 18 years, she is likely entitled to:

- End of service gratuity (calculated based on her years of service),

- Payment for any unused annual leave and days off, and

- Any other pending salary or benefits as per the contract.

If her employer has not paid these dues, she can file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE) or the labour court to claim her rights.

We can assist in reviewing her case and guiding you on how to proceed legally to recover her entitlements.

Please let us know if you’d like to schedule a consultation.

Best regards,

Dear Sir,

She is entitled to claim the end-of-service benefits. For the first five years, she is entitled to 21 days of benefits. After that, she is entitled to 30 days for each year, not exceeding the salary for two years of work.

For more information, contact us.

Hello,

Your mother is entitled to end-of-service benefits, unpaid annual leave, and payment for any unused days off according to UAE domestic labour law.

Since she worked as a nanny for 18 years, the family should pay her gratuity based on her last salary, plus any unpaid leave and days off.

If the family has not paid these dues, you can file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE), which handles domestic worker disputes and can enforce payment.

If you need assistance with the complaint process or calculating the amounts owed, please let me know. We are here to help.
