Can I appeal to recover the fines paid for hiring an employee on a visit visa?

Hello,

I have received a fine of 50K as an owner for appointing an employee on a visiting visa, and the employee received a 10K fine. It has been paid.

Please advise if there is any possibility of getting this money back by appeal.

This is my first fine ever, and the employee’s visa has now been stamped.

Thank you for your message!

I understand this was your first offence, and the fines, AED 50,000 for you as the business owner and AED 10,000 for the employee, have already been paid.

The visa is now stamped, which indicates the matter was regularised, but unfortunately, once immigration or labour fines are paid, it becomes extremely difficult to reverse or recover them.

That said, there are limited cases where an appeal may be considered, especially if there was a procedural error or if you can demonstrate a genuine misunderstanding and cooperation, along with supporting documents to show it was unintentional and swiftly corrected.

Since this is your first violation, we can attempt to file a grievance with the relevant authority requesting a review or partial refund, but I must be transparent that the chances of recovery are generally low once payment is made.

Still, if you wish to try, I’d be happy to prepare the appeal for you and handle the submission.

Please reach out to me on WhatsApp or phone at [------------] so we can discuss the timeline, documents, and next steps.

Hello,

You can file the appeal through the Ministry of Human Resources and Emiratisation (MOHRE) or the Immigration department where the fine was issued.

Provide evidence that the visa has now been properly stamped and the employee is legally employed.

Demonstrate your good conduct and that this was an unintentional first-time mistake. Full refunds are rare, but a reduction in fine or cancellation is sometimes granted in cases of first-time offenses, especially if you regularized the employee promptly.

Dear Inquirer,

Fines for employing a worker on a visit visa are serious, but there may be a possibility to appeal depending on the circumstances and timing of your payment. Since the employee’s visa is now stamped, this could support your case.

To evaluate your specific situation and explore the chances of recovering the fines, we recommend booking a consultation or appointing our firm to handle the appeal process on your behalf.

Dear Client,

Fines for employing someone on a visit visa are usually strict and non-refundable, even if it’s your first offense.

Since the fine has already been paid, getting a refund through an appeal is unlikely unless there was a clear administrative error.

However, if you believe the fine was wrongly imposed, you can submit a formal appeal with supporting documents.

I can assist you with reviewing your case and preparing the appeal if you wish. Let me know if you’d like professional help with this.

Dear Questioner,

Thank you for your message!

Regarding the fines imposed on you as an employer for appointing an employee on a visiting visa (AED 50,000) and the employee’s fine (AED 10,000), since these fines have already been paid and the employee’s visa is now stamped, here is some guidance:

1. Appealing the Fine:

It is possible to file an appeal against fines related to visa violations with the Ministry of Human Resources and Emiratisation (MOHRE) or the relevant immigration authority. However, appeals are generally considered if there are valid reasons such as:

- First-time offense,

- Corrective actions taken promptly, and

- Genuine misunderstanding or procedural errors.

2. Success of Appeal:

The success of an appeal depends on the circumstances and the discretion of the authorities. Since this is your first fine and the issue has been rectified, you may have a reasonable chance to reduce or waive the fines.

3. Appeal Process:

Appeals must be submitted within a certain timeframe after payment and violation notification. It typically requires:

- A formal written appeal letter,

- Supporting documents showing rectification (e.g., visa stamping), and

- Explanation of the situation.

If you wish, we can assist you with preparing and submitting the appeal to increase the chances of a successful outcome.

Please let me know how you would like to proceed.

Best regards,

Mohammed Salah

You may be able to recover the AED 50,000 fine (and AED 10,000 for the employee) by filing an appeal with the UAE Ministry of Human Resources and Emiratisation (MOHRE), especially since this is your first violation and the employee’s visa has now been properly stamped.

MOHRE has the discretion to reduce or waive fines in first-time or rectified cases, and you should submit a written appeal with supporting documents such as fine receipts, visa proof, and your business license.

You can also check with INJAZA or GDRFA if any part of the fine was issued under immigration violations, as they have a Fines Committee for such cases.

Monitor for any current amnesty periods, and consider engaging a PRO to assist with the process for better chances of success.

According to UAE law, employing someone on a visit visa is a legal violation subject to fines, even if it’s your first offense.

Once the fine is paid, refunds are generally not granted unless a formal appeal is submitted within a specific time frame with strong legal justifications.
