How can we claim our money back if the cheque we received have bounced for insufficient funds?

We received a cheque which has now bounced. We have tried for over a month and a half now to get a new cheque from the person, and every day he says the next day.

We need the money now. We have been to the police station, and they said they can not do anything as the reason the cheque bounced is "Insufficient funds."

We have been to Al Barsha - Dubai Courts, and they said there is nothing they can do about it.

We are not sure what we can do. We need the money asap to pay our kids' school fees, let alone all the interest we have lost.

Hi,

Please advise if we will be able to claim legal fees from the company. The cheque is for 125,000.

In your situation, where a cheque has bounced due to insufficient funds and informal attempts to collect a replacement have failed, there are formal legal avenues available in the UAE to recover your money.

Firstly, you may file a civil claim for the value of the cheque before the competent civil court, based on the dishonoured cheque.

Under Federal Decree-Law No. 50 of 2022 Promulgating the Commercial Transactions Law, a cheque is considered an instrument, and if returned unpaid, the cheque holder has the right to proceed with execution directly.

A cheque drawn in the State and payable therein shall be considered an executive instrument, in accordance with the provisions of the Civil Procedures Law, and its bearer may request its compulsory execution wholly or partially, in accordance with the procedures and rules stipulated in the said Law, in the event that it is not paid for reasons related to insufficient funds.

You can proceed to open an execution case at the Execution Court by submitting the original cheque along with the bank’s return memo (stating 'insufficient funds'), and request the court to enforce the payment.

The court can issue orders for attachment on the debtor’s assets, bank accounts, or salary, as well as travel bans if necessary.

Given the urgency due to your financial obligations, I recommend you take swift legal action through the execution court to secure the recovery of the cheque amount.

The primary avenue for recovering the money now is through the civil courts. Since the Al Barsha Courts indicated they couldn't do anything at that moment, it's possible they meant they wouldn't initiate criminal proceedings.
