Can I claim Emirati citizenship if my biological father is Emirati but never took responsibility?

Hello,

I am 18, and my biological father is an Emirati local who never took responsibility. He has blocked me on everything, and we have never spoken.

Both of my parents were married at the time, so I am under another man’s name, but he also abandoned me and my family about nine years ago.

I would really appreciate guidance on what to do right now, as I want to know if I can obtain citizenship or any legal status.

Hello,

According to UAE law, Emirati nationality is typically passed down through the father.

If your biological father is Emirati, you may have a claim to UAE citizenship, although the situation becomes more complex if he hasn't taken responsibility for you and you're under the name of another man.

Your legal rights in this case would depend on the specific circumstances, including whether your biological father acknowledged you or whether your mother’s situation with the other man was legally recognized.

Gather any documents that might be useful in proving your identity, family relationships, and the situation with your parents.

Birth certificates, proof of the marriage of your parents (or lack of), any communication from your father, or documents showing the abandonment by the other man might be relevant.

There may be a pathway for you to obtain Emirati citizenship through your biological father due to his status as an Emirati local.

However, significant challenges exist due to his lack of involvement in your life and potential issues with legal recognition.

It is crucial to gather all necessary documentation and consult legal experts specializing in UAE nationality law for personalized advice tailored to your situation.

Your potential path to obtaining Emirati citizenship largely depends on establishing a formal connection with your biological father and navigating the complexities of local nationality laws.

How do I start? What documents should I obtain, and where can I find legal experts to consult? Since I live in Lebanon, it’s hard to connect with the UAE.

Navigating citizenship issues can be complex, but to pursue Emirati citizenship, you should understand your eligibility through the "jus sanguinis" principle by gathering necessary documents like your birth certificate and proof of your father's identity.

Consult with legal experts familiar with UAE nationality law, contact the UAE embassy in Lebanon for guidance, and follow the application process with the support of your lawyer.

Please get in touch with us via phone or email.

Dear Questioner,

Thank you for sharing your situation!

Based on the details provided, here’s an overview of your options:

1. Eligibility for Citizenship:

As your biological father is an Emirati national, you may be eligible for UAE citizenship. However, the process is complicated if your father has not acknowledged or taken responsibility for you. This could affect your ability to claim citizenship.

2. Legal Steps:

- Contact Authorities:

Reach out to EIDA or GDRFA to inquire about the process for citizenship based on descent. They can guide you on the requirements and procedure.

- Legal Recognition of Paternity:

If your father hasn’t recognized you, you may need to seek legal recognition through the courts to confirm paternity.

- Consult a Family Lawyer:

I recommend seeking legal assistance from us as a lawyer specializing in personal status law to help with the process.

- National ID:

If your citizenship is recognized, you can then apply for an Emirati National ID once the legal process is completed.

Please let me know if you need assistance with the next steps, and I’d be happy to guide you further.

Best regards,

I appreciate the sensitivity of this matter and understand your desire for clarity.

Given the circumstances you've described, here are some professional recommendations:

1. Legal Consultation:

It is imperative to seek advice from a lawyer specializing in UAE citizenship and family law. They can provide tailored guidance based on the nuances of your case.

2. Documentation:

Gather any available evidence that may support your claim, including birth records, correspondence, or other relevant documents.

3. Paternity Verification:

Consider the possibility of DNA testing to establish biological relationships. However, please discuss the legal implications with your attorney before proceeding.

4. Alternative Pathways:

Explore other options for long-term residency or citizenship in the UAE, as your lawyer may advise.

5. Emotional Support:

Given the personal nature of this situation, professional counseling may be beneficial as you navigate this process.

Thank you for reaching out!

Your situation is complex, and I understand how important it is for you to clarify your rights regarding citizenship and legal recognition.

In the UAE, nationality laws are specific and proving paternity is a key factor in claiming citizenship. Since your biological father is an Emirati, there may be legal avenues to establish your lineage, but this typically requires official documentation and possibly a legal case.

Additionally, given the circumstances of your legal identity, there may be ways to correct or update your records.

I would need to review your case in detail to advise you on the best course of action.

Please reach out to me via WhatsApp or phone, and we can discuss the legal steps available to you.

Best regards,

Suhail Rana
