I resigned and my company asked me to sign the cancellation paper before paying my dues. Should I do that?

I resigned from my job in Dubai and I had to travel back to my home country right after the notice period. The company asked me to sign the cancellation paper as they will need 4-5 days to pay all settlements.

As I have to leave the country, they asked if there will be a problem with cancellation if I leave the country and just sign so they can proceed with my cancellation and payments which they will do in a few days.

Should I do that?

Greetings,

It is not advisable to sign the visa cancellation documents before receiving your full end-of-service settlement.

Once your visa is canceled, enforcing your rights becomes more difficult, especially if you leave the UAE.

You should ensure that:

- All dues are settled before signing.

- You receive proof of payment or a written commitment with a clear payment timeline.

- You consult a legal expert if the company insists on cancellation without immediate settlement.

Dear Sir/Madam,

Thank you for reaching out regarding your resignation and the subsequent visa cancellation process. I understand your situation and the urgency to travel back to your home country.

However, based on the information you've provided, I would like to offer the following professional advice:

1. Settlement Before Cancellation:

It is generally advisable to receive all your dues and settlements before signing any cancellation papers. This ensures that your rights are protected and that you have received all entitled benefits.

2. Grace Period Utilization:

After visa cancellation, you typically have a 30-day grace period to remain in the UAE legally. This should provide ample time for your company to process your payments while you're still in the country.

3. Document Retention:

Ensure that you have possession of your passport and Emirates ID. These documents should be returned to you after the visa cancellation is approved.

4. Verification of Settlements:

It's crucial to verify and receive all your end-of-service benefits and any outstanding dues before your departure.

5. Legal Implications:

Signing cancellation papers and leaving the country before receiving your settlements may weaken your position in case of any future disputes.

Recommendations:

1. Request your employer to initiate the cancellation process immediately, as this can often be done online.

2. Insist on receiving your settlements before signing any cancellation documents.

3. If possible, consider adjusting your travel plans to accommodate the 4-5 days your company needs to process the payments.

4. If you must leave urgently, explore the option of granting power of attorney to a trusted individual who can handle the process on your behalf.

Please note that it is your legal right to receive all due payments before visa cancellation. If your employer is uncooperative, you have the option to file a complaint with the Ministry of Human Resources and Emiratisation.

Should you require any further clarification or assistance, please don't hesitate to reach out.

Best regards,

Once you sign the cancellation paper and leave the country, you lose significant leverage in ensuring you receive your full settlement.

It will become much more difficult to pursue your rights from abroad. Ideally, you should not sign the cancellation paper until you have received your full settlement.

Insist on receiving your payment before you leave the UAE. If the company insists on you signing before payment, demand a detailed written agreement that clearly states:

- The exact amount of your settlement

- The date by which the payment will be made

- The method of payment

- That they are liable for all legal expenses should they not fulfill this agreement.

If you need further clarification, you may ask.

Dear Questioner,

Thank you for your inquiry.

It is not advisable to sign any documents without fully understanding the terms and consequences. It is important to consult with a legal professional before signing any documents related to your employment and cancellation.

Additionally, it is important to ensure that all settlements and payments are made before leaving the country. If you have any concerns or doubts, it is best to clarify them with your employer before signing any documents.

Please do not hesitate to reach out for further inquiries.

Your situation requires careful handling to ensure you receive your full end-of-service benefits before leaving the country.

While it is common for companies to request employees to sign cancellation documents before settlement, doing so without receiving your dues carries risks.

Once your visa is canceled and you leave the UAE, enforcing your rights can become challenging.

I recommend ensuring that you either receive your final settlement before signing or get a legally binding written confirmation from the company regarding the payment timeline.

I have handled similar cases and can assist you in ensuring a smooth and secure process.

Feel free to reach out to me via WhatsApp or phone to discuss the best course of action.

Best regards,

Suhail Rana
