Can a company that I witnessed against in a fraud case file a case against me?

I and two of my employees gave witness against some people in Ajman that I saw selling a container of cell phones that they took from a guy they cheated.

Also, I witnessed that they were involved in the fraud. They got convicted and they made an appeal.

Now they did the following:

1) The company owner (Staying in Pakistan) confessed in the objection that he did everything legally, such as signing an agreement and selling the company to a company other than the person I witnessed against.

2) They mentioned the mistake in my dates that the material was sold inside the port directly from company to company not by them. I gave dates of witnessing them 5 days later as compared to papers of delivery given by Dubai customs under name of buyer.

3) They showed that they have previous cases against me that I did not tell the court, prosecution, and judge.

Can they get easy acquittal?

How can I stop them from getting acquittal because after acquittal they will surely open a case against me?

According to UAE law, the defendants have the right to appeal the judgment if there is new evidence or information presented in court.

However, if you have strong evidence supporting the validity of your testimony, you can submit it to the court to support your position.

You can contact us via WhatsApp for specialized legal consultation on how to handle this situation, as we specialize in such cases.

In legal proceedings, an appeal allows a party to request a higher court to review a lower court's decision based on grounds such as legal errors, procedural mistakes, or new evidence.

In your case, the defendants are challenging your testimony to seek acquittal through several means, including the owner's confession of acting independently, which could undermine your position if contradicted; allegations of discrepancies in transaction dates that may weaken your testimony; and the introduction of previous undisclosed cases against you that raise questions about your credibility.

To effectively counter the defense, it is critical to gather relevant evidence supporting your testimony, such as timestamps, photos, or additional witness statements, consult legal counsel experienced in criminal law to guide you through the appeal process, and prepare to challenge their claims regarding dates and prior cases with evidence demonstrating your reliability.

Potential outcomes may vary; if the defense successfully argues without strong counter-evidence from you, they could achieve an acquittal, but robust evidence supporting your claims can significantly bolster your position.

Moreover, to prevent potential retaliation from the defendants if they are acquitted, it is essential to document all interactions and consider seeking legal protective measures against harassment or defamation.

Despite the various avenues for the defense to pursue acquittal, taking proactive measures can greatly influence the outcome of the case in your favor.

Strengthen Your Testimony: Ensure your statement aligns with your employees’ and provide any additional evidence (CCTV, records).

Counter Their Claims: The owner’s confession doesn’t clear them, date discrepancies don’t invalidate your testimony, and past cases against you are irrelevant.

Hire a Lawyer: A strong defense is crucial to challenge their appeal.

Be Prepared for Retaliation: Keep evidence safe and be ready to file a counter-case if they accuse you falsely.

Follow Up on the Appeal: Work with the prosecution to ensure your testimony stands.

Greetings,

The appeal process allows the convicted parties to challenge the evidence, but their arguments do not necessarily guarantee an acquittal. Here’s what you should consider:

Confession by the Company Owner: If the owner (based in Pakistan) now claims full responsibility, the court will assess whether this statement is credible or an attempt to mislead the judiciary.

Discrepancy in Dates: Minor inconsistencies in dates do not automatically invalidate your testimony, especially if other evidence supports your statement.

Previous Cases Against You: The existence of past cases does not directly impact the validity of your testimony unless they are directly relevant to this matter.

To strengthen the case and prevent an acquittal, it is crucial to legally counter their claims with strong evidence and expert legal representation.

Dear Client,

Thanks for your question!

I hope you are doing well. I will assist you in this matter.

Given the complex situation, the appeal's outcome is uncertain. The new evidence, including the company owner's confession and date discrepancies, could impact the case.

The Court of Appeal may review this information and potentially reconsider the original verdict. The undisclosed previous cases against you might also be relevant.

To counter these issues, work closely with the prosecution to provide any necessary clarifications or additional evidence supporting your original testimony.

While you can't directly appeal as a witness, you can assist the prosecution. If an acquittal occurs, the defendants may file a case against you.

However, if your testimony was given in good faith, you should have some legal protection. Seeking professional legal advice is highly recommended.

You can contact us via WhatsApp for further clarification or additional support. We are dedicated to providing professional, timely, and comprehensive assistance tailored to your situation.

Thank you,

ABDUL WAHIED
