Can we give a salary certificate to a new hired employee before he starts to open a bank account?

Dear lawyers,

The new employee will start on June 1, 2025. However, he would like to open a new bank account in the UAE thus asking to provide the salary certificate mentioning his salary in AED and if possible not mentioning the start date.

Legally, can the company provide such a certificate?

Greetings.

The salary certificate is the right of the worker, but it must be stated that he started work on such and such a date, and is still working until the date of issuing this certificate on such and such a date, so that the company does not bear any credit responsibilities later towards the bank because the period of work shows the financial solvency of the worker with the bank.

According to UAE law, the company cannot issue a salary certificate without mentioning the start date, as the documents must be accurate and truthful.

Omitting the start date could lead to legal issues.

You can contact us via WhatsApp for the necessary legal support. We specialize in such cases and provide appropriate guidance.

The company can provide a salary certificate, but it must be accurate. If the employee hasn't started yet, the certificate should mention the start date.

Excluding the start date is not typical, as the bank may require it for verification. It’s best to confirm with the company’s HR or legal team for compliance.

You must write the date you started working at the company because sometimes some banks require the date you started working.

Hello,

Instead of a salary certificate, the company could issue an employment offer letter or employment confirmation letter, which outlines the agreed salary and employment start date.

This letter would state that the employee is hired and is expected to begin work on June 1, 2025, and the salary (in AED) will be as agreed.

However, it cannot be used as a salary certificate until the employee actually starts working and receives their first payment.

Dear Client,

Thanks for your question!

I hope you are doing well. I will assist you in this matter.

The company can legally provide a salary certificate for the new employee but should ensure it accurately reflects the agreed salary in AED and clearly states the June 1, 2025 start date to avoid potential misrepresentation.

The certificate should include all required information such as the employee's name, job title, salary breakdown, and company details, and be presented on company letterhead with an official stamp and authorized signature.

While assisting the employee is acceptable, it's crucial to maintain accuracy and transparency in compliance with UAE labor laws.

Omitting the start date is not recommended as it could be seen as misleading. The company should balance helping the employee with ensuring all documentation is legally compliant.

You can contact us via WhatsApp for further clarification or additional support. We are dedicated to providing professional, timely, and comprehensive assistance tailored to your situation.

Thank you,

ABDUL WAHIED

The employee can only be granted a salary certificate after starting actual work and issuing the residence.

In case of further inquiry, we can help you on the phone.

Hi,

Pursuant to your query, you can give him a salary certificate but better to mention the date he joined the company.

while it may be technically possible for a company to issue a salary certificate without mentioning the start date, doing so before June 1, 2025—when the employee will actually begin work could pose significant risks related to accuracy and legality. Therefore:

The company should refrain from issuing a salary certificate until after the employee has officially started working on June 1, 2025.

Greetings,

If you are providing salary certificate from now that is a proof that he is now carrying his job as an employee.
