I have a cases and travel ban for loans and credit cards. Can I pay the fine and clear them?

I had 10 loans in 2010 from various banks and credit cards and left the country due to job loss.

2 of those banks no longer exist today, and 3 of the banks have put a case and travel ban on me.

Now I spoke to a lawyer and he said they can clear the 3 cases by paying a fine/fees.

Will the bank still chase me for the remaining debt after this clearance process?

I plan to return to the UAE to work on a new job.

What about the remaining 5 banks that have not filed a case for personal loans/credit cards?

And what about the 2 banks that closed (for example [----])?

Thank you

Dear Questioner,

Thank you for reaching out.

Based on your situation, here are the answers to your questions regarding the debts, travel ban, and your ability to return to the UAE:

1. Will the Bank Still Chase Me for Remaining Debt After Paying a Fine/Fee to Clear the 3 Cases?

Clearing the cases by paying a fine or fees will only resolve the criminal aspect of the debt related to the legal cases filed against you by the banks.

Once you clear the criminal case, you will no longer face a travel ban, and you should be able to enter the UAE.

However, paying the fine does not forgive the outstanding debt. The banks may still pursue you for the remaining unpaid debt through civil action.

This means the banks can still take legal action to claim the amount owed through the civil courts, even after the criminal cases are cleared.

It’s important to settle the debts to avoid further legal action, including possible wage garnishment or other collection methods.

2. What About the Remaining 5 Banks That Have Not Filed a Case for Personal Loans/Credit Cards?

For the 5 remaining banks where no cases have been filed, you are still legally liable for the outstanding debts.

Banks in the UAE typically allow a certain period for collection before taking legal action. However, they may still file a case or pursue other methods of debt collection in the future.

Interest and penalties may have accrued on the original amounts owed, so the outstanding amount may have increased over time.

You should contact these banks to settle or negotiate the debt to prevent future legal actions or complications.

If you plan to return to the UAE, it is advisable to clear any outstanding debts with these banks to avoid potential legal action and to ensure you can legally reside and work in the UAE.

3. What About the 2 Banks That Closed (e.g., [-----])?

If the banks have closed or merged, the outstanding debts would typically be transferred to the successor bank or a debt collection agency.

Even though the original bank no longer exists, the debt remains valid, and you can still be pursued for it.

It’s advisable to contact the successor bank or the collection agency that took over the debts and negotiate a payment plan.

If you are unsure which entity is handling the debt, you may want to inquire at the Central Bank of the UAE for details regarding the status of your outstanding loans.

Steps to Take:

Clear criminal cases: You can proceed with settling the fines/fees to clear the criminal cases, which will remove the travel ban and allow you to return to the UAE. However, this does not eliminate the debt.

Contact the banks: For the 5 remaining banks, contact them to discuss settlement or repayment options before you return to the UAE. This will help prevent new legal actions and protect your ability to work and stay in the country.

Check the status of closed banks: For the 2 closed banks, determine which entity is handling the debt, and ensure that you resolve the outstanding amounts.

It’s also recommended to seek legal advice to negotiate settlements with the banks, especially considering the length of time that has passed since the debts were incurred.

If you need further assistance in resolving these matters or if you wish to proceed with any legal action, feel free to reach out. I'm here to help.

Best regards,

Dear Sir,

Before taking any action, you must do an investigation first to check what's the status now because it has been a long time.

Also what about those 2 banks that are already closed, what action has been taken by other banks, and where has the case reached?

Maybe it's finished because it's time-barred.

Let's do an investigation to update you and provide a clear picture regarding this.

As per UAE law:

1. Banks with cases and travel bans: If you settle the three cases by paying the fines/fees, the travel ban will be lifted.

However, this does not mean the remaining debt is forgiven. The banks may still pursue the outstanding amounts through civil recovery procedures.

2. Banks that have not filed cases: The absence of a case does not mean the debt has been waived. These banks can still pursue collection or file cases in the future, especially if you return to the UAE.

3. Closed banks (e.g., [----]): When a bank closes, its liabilities, including debts, are typically transferred to another bank or financial institution.

The debt may still exist, and you can check with the UAE Central Bank to verify the status of the debt.

Dear questioner

Even if you close the case at the police station, the travel ban can be removed instantly, however, after some time the banks can initiate a civil case against you for further recovery.

Regarding the loans issued by the closed banks, if they had merged and some other banks to whom they got merged have recovery rights then they can initiate the legal proceedings but this will not happen immediately and have a lot of legal constraints also it can easily settled.

Dear Client,

Thanks for your question!

I hope you are doing well. I will assist you in this matter.

Clearing the 3 cases with fines may remove travel bans but doesn't necessarily clear the underlying debt. Banks could still pursue you upon return to UAE.

For the 5 banks without cases, debts may be time-barred after 15 years, but consult a legal expert. Debts from closed banks might have been transferred and remain valid.

Before returning, consider negotiating settlements with all creditors, exploring debt consolidation, and seeking legal advice.

Check your Al Etihad Credit Bureau report for current debt status. Returning with unresolved debts is risky; banks may reinitiate legal action.

Address all outstanding debts proactively to ensure a smooth return to the UAE for work.

Thanks & Regards,

Clearing existing legal cases will help alleviate immediate concerns but does not eliminate your overall debt obligations.

Remaining debts may still be pursued by both active and inactive institutions depending on their policies and practices.

It’s advisable to maintain open communication with all involved parties and consider negotiating settlements where possible.

Before returning to work in the UAE, ensure all aspects of your financial obligations are addressed comprehensively.

First, we should check the details relating to your travel ban to see the current status.

We can do so by running security checks with the relevant authorities like the police, Immigration departments, and the concerned courts.

We will need the following details to proceed with the security checks:

1. In which Emirates did these crimes happen?

2. Power of attorney

3. Emirates ID and email ID

Please note that the time taken for conducting security checks will be 1 to 3 days and securing the Power of Attorney will take 3 to 7 days.

After running the security check and inspecting the current status of your ban, we can assist you further by providing you with potential legal solutions.

Looking forward to your response. Please feel free to reach out to us on our WhatsApp number.
