How can I resolve a rejected ILOE claim despite no disciplinary reason for termination?

Hi everyone,

I need your guidance on how I can claim my ILOE insurance. I received an email from my employer stating that they do not want to renew my agreement.

I have been working for this company for more than 4 years, and during my notice period, there was no mention of any reason for my termination, such as disciplinary issues.

However, after completing my notice period, when I received my cancellation paper and applied for ILOE claims, it was rejected due to disciplinary reasons. How can I resolve this?

Please guide me!

Dear Questioner,

Thank you for reaching out to me regarding the rejection of your ILOE insurance claim. I understand this situation can be stressful, and I will assist you in taking the necessary steps to resolve this matter.

Based on the information you’ve provided, your claim was rejected due to the stated reason of disciplinary grounds for your termination.

However, as you mentioned, your termination was not related to any disciplinary reasons, and this rejection may be based on an incorrect assessment.

Steps to Resolve the Issue:

1. Clarify the Nature of Termination:

The first step is to obtain a clear written statement from your employer confirming that your termination was not due to disciplinary reasons.

If you have any emails or communication from the employer that mention the termination is for non-disciplinary reasons (such as end of contract, redundancy, or other valid reasons), it will help support your case.

If no such communication exists, you should request an official letter from your employer clarifying the reasons for your termination.

2. Review Employment Records:

Go through your employment contract and any records that pertain to your termination to ensure there is no record or mention of any disciplinary actions against you.

If you were not formally warned or subjected to disciplinary actions, this can further strengthen your case.

3. Appeal the ILOE Claim Rejection:

If your employer confirms that the termination was non-disciplinary, you can file an appeal to the Ministry of Human Resources and Emiratisation (MOHRE).

The appeal should include all relevant documentation, including the clarification letter from your employer (if available), your termination records, and any communication that demonstrates the termination was not disciplinary.

MOHRE will review the evidence and may reverse the rejection if the termination is found to be non-disciplinary in nature.

If the matter is not resolved through an appeal or mediation, we can consider other legal options, including approaching the courts for further assistance.

Please forward me any correspondence you have with your employer or documentation regarding your termination so I can assess and assist with filing the necessary appeal.

It’s important to act swiftly to correct any inaccuracies in the claim and to follow the appropriate legal channels. We can submit an appeal to MOHRE or the relevant authorities with the necessary documentation to ensure your eligibility for the ILOE insurance claim.

Let me know how you would like to proceed, and feel free to send over the documents so that I can assist you further.

Best regards,

Mohammed Salah

Dear Client,

Thanks for your question! I hope you are doing well. I will assist you in this matter.

To claim your ILOE (Involuntary Loss of Employment) insurance after a rejection due to alleged disciplinary reasons, you should first gather all relevant documentation, including your termination letter and any correspondence with your employer that clarifies the reason for your termination.

Since you mentioned that there is no disciplinary reason for your termination, ensure that you highlight this discrepancy in your claim submission.

You can submit your claim through the ILOE portal by following the steps outlined there, making sure to attach supporting documents that demonstrate your case.

If your claim is still rejected, consider reaching out to Dubai Insurance for clarification or filing a formal complaint with the Ministry of Human Resources and Emiratisation (MOHRE).

Additionally, seeking legal advice may help you navigate this process and rectify any errors in the cancellation paperwork that could be affecting your claim.

Thanks & Regards,

Hello,

According to UAE law, if your claim for ILOE insurance is rejected due to incorrect disciplinary reasons, you can appeal the decision with the relevant authority.

You will need to provide documents that prove there were no disciplinary grounds for your termination.

We can assist you in filing an official complaint to the authority or court to review and reconsider your claim.
