I gave a brand expensive watch to agent for service and they changed delivery and fees. What can I do?

Dear.

I gave a brand and expensive watch to an agent for service. Only 'normal service' at the beginning of 2024. They gave me an estimate and completion time and on this basis, I agreed.

Later, they changed the price for service and time for completion many times without my agreement, I told them this was not acceptable because I already agreed and given my watch.

Until now, my watch is not done and they have not replied to me with an update or anything. I have already reported this to consumer protection in Dubai.

They already spoke to them but no use and told me I could try legal action if I wanted. I am confused and cannot believe a famous shop can do this with a business license and take valuables like this.

Kindly give me an idea of what I can do. I have all communications in email and sms.

Hello,

You can send a legal notice to the service provider.

This letter should clearly state the original agreement you made (price, service details, and time of completion), the repeated price and time changes without your consent, and the lack of updates or responses.

You can ask for either a refund, the return of your watch, or the completion of the service according to the original terms.

Set a deadline for them to respond (usually 7–10 days). If they do not respond, you can use this letter as evidence for further legal action.

If they didn't comply with this, You can file a civil claim against the service provider for the breach of contract or for failure to perform the agreed service.

If the service provider is a licensed business in Dubai, you can also file a complaint with the Dubai Economy (DED), which regulates commercial practices in the emirate.

You may be able to seek damages if the service provider’s actions caused you financial loss or other negative consequences.

Tank you Mr. Khaled for reply and explanation. But is case for damages strong? How can we prove financial damage from watch? Other loss is time loss which I wasted follow up with them, but also how can we calculate this? Can you explane please? Thank you..

If the watch is a luxury item or has a significant resale value, we can argue that the prolonged repair time or mishandling (if it occurred) has resulted in a loss of value. if the watch was supposed to be fully serviced and in a pristine condition, but the delays or mishandling caused damage or a decrease in market value, we can claim that difference in the watch's value before and after service. for a detailed discussion kindly share your whatsapp number.

Please send us the document acknowledging the agent's receipt of the expensive watch and prepare a legal power of attorney to take action to claim the return of the watch or its monetary equivalent, along with legal interest.

Additionally, request compensation proportional to the damage caused to you and any lost profits due to the depreciation in the value of the watch if too much time has passed, in order to proceed as quickly as possible.

I have no experance how to calculate the depreciate value of a watch for pass of 9 months. Which is also not much maybe. Would we be able to refuse to take watch back and force them to give current market price? Honestly by now I have bad feeling of this watch and do not even want it because not sure maybe they broke something or take something out etc.. What you think? Thank you.

You made very good point! After all I pass through with them, really I do not like the watch anymore. Also I am worry mabe they do something to watch or replace small diamond with else or something like that. Because 9month very long time and I am sure that agent of expensive watch like this not taking this long for normal service only! It was battery and oil service only and 9 months! You can bild house in 9 month. Soemthing not right.

If watch return and no service, then I simply lost time with nothing and now doubt in my watch. Claim price of watch is better for me honesly, but they will then just return and say sorry we cannot give price but here is your watch take it... Correct? Or legaly it is possible?

Yes exactly i ask same question. They said sorry we cannot fix here and must send to swiss factory for fixing! Then later said that swiss watch maker will not give them reason also! I told them then what is point of inspection report you made and gave me with cost and time for service?? Plus I am force to fix with them because they are only agent and watch price drop if I fix elsewhere. Not fair to force to go to agent if the agent is doing like this. Agent does not mean right to play with market and customer of original swiss product correct?

Also consumer protection first gave them date and they violate this completion date.. later consumer protect also not answering me meaning they cannot do anything for them.. very bad

Consumer protect laster close the complain and said after you can open followup. When I open followup which take them 1 month to open, then they just ignoring me

Your only option now is to file a case against them. In the case, you can either request the return of the watch with compensation for losses, demand the market value of the watch, or ask the court to appoint a watch expert to write a report on everything that happened. Based on their report, you can take the next step.
