How can I reduce my 2-month notice period to 1 month for a new opportunity?

Dear Lawyers,

My notice period, as per my contract, is 2 months, but I have received a very good opportunity. I would like to serve a 1-month notice period instead.

What can be done in this regard?

The party that did not comply with the notice period must pay the other party compensation called notice allowance, even if the lack of notice did not result in harm to the other party.

The compensation shall be equal to the worker’s wage for the entire notice period or the remaining part of it.

Hello,

Under Article 43 of the UAE Labor Law, either party may terminate the employment contract for a legitimate reason by providing written notice, and the agreed-upon notice period must be observed.

While the minimum notice period is 30 days, and the maximum is 90 days, the specific period specified in your contract is two months.

The law allows both parties to agree to reduce or waive this notice period; however, if you are unable to serve the full two months and no agreement is reached with your employer to reduce this, you would be required to compensate for the remaining notice period.

In your case, I recommend formally notifying your employer of your resignation with the full two-month notice as per your contract and fulfilling as much of this period as possible.

Should you leave before completing the full period, you may be liable to compensate your employer for the remaining days. This compensation, known as "notice compensation," would be calculated based on your last received salary.
