Dubai Court placed a hold on my account for another bank's case: what are my options?

Hello,

I received an SMS and email from A bank stating that my bank account is on hold as per a Dubai Court order. I only have AED 2,000 left in my account, which is for my treatment and medication because I have breast cancer.

I lost my job last year and was unable to pay my personal loan installment with B bank. It was B bank that filed a case and a travel ban with Dubai Court.

But how can Dubai Court put a hold on my A bank account, even though the case is with another bank (B bank)?

Dear Questioner,

Yes, the court can seize all your bank accounts until the amount is paid or a settlement is reached with the bank.

If you have any other inquiries, contact us on phone number [-----------].

Can I explain to the court that I was made redundant from work, haven’t found a new job, and was diagnosed with breast cancer, hence I am unable to pay the loan installment?

I don’t have a single dirham left because my last money is in my A bank account, which was put on hold.

Dear Questioner,

Thanks for your inquiry!

According to UAE law, a bank can put a hold on your account if there is a court order to do so.

In this case, it seems that the court has issued an order to put a hold on all your bank accounts, including your A bank account, in order to collect the outstanding debt from your personal loan with B bank. This is legal and within the rights of the court.

If you have concerns about the amount of money in your account being used for your medical treatment, you should contact the court and provide them with proof of your medical condition and the need for the funds.

They may be able to release a portion of the funds for your treatment.

It is also important to note that ignoring a court order can result in further legal consequences, so it is best to address the issue as soon as possible.

You may also want to seek legal advice from us as a lawyer who specializes in debt and banking laws in the UAE.

I don’t have work, and I don’t have funds. I want to address the issue as soon as possible, but I won’t be able to pay you or any other lawyer. I am in a very tough situation.

Dear Questioner,

I'm sorry to hear about your current situation and the challenges you're facing.

In the UAE, when a creditor, such as B bank, obtains a court order due to unpaid debts, the court can issue a directive to freeze the debtor's assets across various banks, not just the one where the debt originated.

This means that even though your debt is with B bank, the Dubai Court has the authority to place a hold on your A bank account to secure the outstanding amount.

Given your medical condition and the necessity of accessing funds for treatment, it's crucial to address this matter promptly. I recommend the following steps:

- Contact the Court:

Reach out to the Dubai Court to explain your medical circumstances and request a reconsideration of the account hold, emphasizing the need for funds for essential medical expenses.

- Communicate with B bank:

Engage with B bank to discuss your situation. They may offer a restructuring of your loan or provide a temporary relief plan considering your health condition.

- Seek Legal Assistance:

Navigating this process can be complex, and having legal support can be invaluable. I am available to assist you in communicating with the involved parties and exploring possible legal remedies to address the account hold and travel ban.

Please feel free to contact me via WhatsApp or phone at [---------] to discuss your case in detail and determine the best course of action.

Best regards,

Suhail Rana

Hello,

Bank B won’t offer a restructuring of the loan payment plan because I am still unemployed. I even informed them about my diagnosis.

I only have AED 2,000 left in my A bank account, which was reserved for my doctor consultations and medication.

I don’t have any money left with me. I want to seek more of your legal advice, but I’m afraid I won’t be able to pay for your services.

I'm truly sorry to hear about the difficult position you’re in, and I understand how overwhelming this must feel given your health and financial situation.

Please know that my priority is to explore options that can provide some relief, especially considering your medical needs.

In certain situations, there may be legal avenues to appeal or request a partial release of funds from a frozen account, particularly when it pertains to essential medical expenses.

How do I get in touch with Dubai Court? Via their website? I am so overwhelmed with stress right now.

Welcome,

In cases where an account is seized by the court, but the account holder needs funds for essential cancer treatment, an exceptional request can be submitted to the court to partially lift the seizure or to allow access to part of the funds for medical expenses.

Detailed evidence, such as medical reports and invoices, should be provided to support the request. It’s also worth noting that the court may order a seizure on multiple accounts, depending on its assessment of the account holder’s financial situation.

We are honored to provide you with legal support. For further inquiries about your topic, you can come to our office or contact us via phone, WhatsApp, or email.

Hello,

Thank you for the reply!

But how do I make an appeal to the Dubai court? I am unemployed and have a chronic condition. I don’t have funds to pay for a lawyer's services.

Dear Questioner,

When a court issues an order related to unpaid debts, it can have a broader impact on your financial accounts, including those held at banks other than the one where the debt originated.

This might explain why your A bank account has been frozen, even though the case is with B bank.

To resolve this issue, we recommend that you contact the Dubai court and Bank B to explain your medical situation and request that the block on your account be lifted, allowing you to access the funds needed for your treatment.

Given your circumstances, you may be able to negotiate a mutually beneficial settlement with the creditors.
