A tenant agreed via email to vacate but later declined. What to do as the new landlord?

Dear Lawyers,

The former owner of a unit sent an email to the tenant stating he wouldn't renew the contract as the unit was being sold.

The tenant acknowledged the email and agreed to vacate the property at the end of the contract, so no eviction notice was issued. Now, the property has been sold.

The tenant has been reminded about the email exchange but no longer acknowledges it and refuses to leave, claiming it has nothing to do with the new owner.

Does the new owner have a claim if they go to the RDC to evict the tenant? Will the email exchange hold in court?

Dear Questioner,

The previous owner's email informing the tenant of non-renewal and the tenant's acknowledgment to vacate at the end of the contract are crucial evidence.

Even though the email wasn't a formal eviction notice, the tenant's written confirmation of their intention to leave strengthens the new owner's case.

Since the tenant previously agreed to vacate at the end of the contract, the new owner has a valid reason for eviction based on non-renewal.

The RDC will review the case, including the tenancy contract, email exchange, and any additional evidence presented by both parties. And it will be the discretion of the judge.
