Can the real estate management increase my rent without notice?
Hi.
My contract expired 4 months ago and I am trying to contact my current landlord who was a bank. They were telling me to go to the office and renew it.
I visited the office, and they told me we sold this building and the new owner will contact you. I was trying to renew because I need Tawtheq for the bank and other work.
After 4 months, the new management company sent me an email in which they increased the rent and also added a service charge of AED 3000 and an admin fee of 500, which was not in my contract. This is my 4th year in that office.
Please let me know how I can go legal for my rights, also they told me if you will not pay we will go legal.
Dear Inquirer
We are pleased to serve you and address your inquiries.
The contract is considered renewed for a new period and the legally prescribed increase fees must be adhered to.
If anything else is required, don’t hesitate to contact us via email or call our offices in Dubai or Sharjah.

Greetings.
You can reject the new increase if it is not commensurate with the rental prices in the area.
Also, hold a meeting with them to discuss the new contract and settle the new rental price, and we can represent you in negotiating with the new owner or the management office.
For further inquiries about your topic, you can reach our office or contact us on WhatsApp.
Dear questioner,
If the new landlord wants to amend or add new conditions to the contract, he shall notify 2 months before the renewal.
You can file a complaint in Abu Dhabi Municipality (ADM) against the same and check if they can collect these maintenance fees.
It seems that there has been a change in ownership or management of the building where your office is located.
And the new management company is now imposing additional charges and increasing the rent, which were not specified in your original contract.
Here are steps you can take to address this situation and assert your rights:
1. Review Your Original Contract: Carefully review the terms and conditions of your original lease agreement with Fab bank to understand your rights and obligations, including any provisions related to rent increases, service charges, and administrative fees.
2. Communicate with the New Management: Reach out to the new management company to express your concerns and seek clarification on the reasons for the rent increase and additional charges. Request documentation or justification for these changes, especially if they were not included in your original contract.
3. Negotiate: If you believe the rent increase and additional charges are unfair or unjustified, try to negotiate with the new management company for a more reasonable resolution. Provide evidence of market rates for similar properties in the area and emphasize your history as a long-term tenant.
4. Seek Legal Advice: If negotiations with the new management company are unsuccessful, consider seeking legal advice from a qualified lawyer who specializes in real estate and tenancy law in the UAE. They can review your original lease agreement, assess the legality of the rent increase and additional charges, and provide guidance on your rights and options for recourse.
5. Document Everything: Keep records of all communication with the new management company, including emails, letters, and any agreements or notices received. Document any discrepancies between the terms of your original contract and the proposed changes by the new management.
6. Explore Dispute Resolution Options: If the dispute cannot be resolved amicably, you may consider exploring alternative dispute resolution methods such as mediation or arbitration. These processes can help facilitate negotiations and reach a mutually acceptable agreement without resorting to litigation.
7. Consider Legal Action: If necessary, you may consider taking legal action against the new management company to assert your rights and challenge the rent increase and additional charges. Your lawyer can advise you on the appropriate legal steps to take and represent your interests in court if litigation becomes necessary.
It's essential to act promptly and assertively to protect your rights as a tenant and ensure that any changes to your lease agreement are fair and lawful.
Seek legal guidance to navigate the complexities of landlord-tenant disputes and advocate for a favorable outcome.
