Enforcement of contracts and scope of non-disclosure agreements
How do the laws of the UAE affect an NDA with one company in California, USA and the second party based in the UAE?
Does the UAE have proper enforcement for the parties to ensure proper guidelines?
Please advise.
Hello Dear,
It is a very open-ended question but generally in case of Non-Disclosure Agreements, if the agreement is bilingual, professionally drafted, registered with the Notary public in the UAE and consulate of USA here in the UAE, that may be fully enforceable in California, USA.
However, there are multiple factors which play a vital role in determining either that agreement can be fully enforceable or not.
Clauses of the agreement such as the choice of governing jurisdiction, method for dispute resolution, limitation clause, the scope of the agreement and many other clauses.
