I filed a case to cancel my visa and pay my dues but my company asked me to withdraw it. What to do?
My company told me to find a new job last November, as they will stop operation from January 2024, though they renewed their Trade License. They said they have no intention of renewing my visa.
In December, I found a job and asked them to cancel my visa but they requested me to stay until 15th January. My Visa expired on 20th January. but till now they haven't canceled my visa, nor given me my December and January salaries and my gratuity.
So I filed a complaint in labor. Now the PRO calls and asks me to cancel the complaint so he can cancel. What should I do?
Dear Client,
Thanks for your question, I hope you are doing well. I will definitely assist you in this matter.
Consult with us to review your options. If the company proposes a settlement, ensure it covers your unpaid salary, gratuity, and visa cancellation.

You can withdraw the complaint once they signed the settlement deed after paying all your dues.
This will be the best option in order to secure all your rights. According to law after official termination, you will be receiving your dues within 14 days.
So regarding the complaint, you may ask your HR to provide you with the settlement agreement along with dues. then you can withdraw the complaint as well.

In a situation like yours, where there are multiple issues involving visa cancellation, unpaid wages, and end-of-service benefits, it is important to proceed with caution and ensure that your rights are protected.
Canceling the complaint might leave you without leverage or a formal mechanism to ensure that the company fulfills its promises.
If the company is genuinely willing to settle the matter, they should be able to provide written assurances and proceed with the necessary actions without requiring you to withdraw your complaint first.

Dear questioner
If you had initiated the case with MOHRE, then you are required to continue with the case or ask the PRO for an agreement to settle the dues and cancel the visa so then you can withdraw the case.
Dear Inquirer
We are pleased to serve you and address your inquiries.
Upon reviewing your query, instead of canceling the complaint, request that a time limit be set for both parties to complete the amicable settlement procedures.
If they are not completed within the agreed-upon date, you can request that the complaint be decided by the Ministry if the value of the dues is 50 thousand or less, or referral to court if it is more than that.
