Imprisonment suspended, but police mention a 3-month term! What now?

Dear Experts,

Two days ago, my cousin was detained with the intention of being transferred to Al Awir for imprisonment and deportation. Following his last appeal, the court suspended his imprisonment, but only a deportation order was issued.

However, when I visited the police station yesterday, they informed me that he has been given a 3-month jail term!

I contacted the public prosecution, and they stated that the case is closed following the second appeal for deportation without imprisonment. Currently, he is in Al Awir jail.

What happens next? His wife and kids are very worried. Can someone help me to assist in getting him back to the country?

Dear Questioner,

Thanks for your inquiry!

Regarding the above, we would like to inform you that, according to UAE law, a deportation order can be issued for a foreigner who has committed a crime or violated immigration laws.

In your cousin's case, it seems that the court has decided to deport him without imprisonment.

However, it is important to note that the final decision on deportation lies with the Ministry of Interior, and they may choose to enforce the deportation order immediately or after the completion of the jail term.

In order to assist your cousin in returning to the country, you can contact the Ministry of Interior and request for their assistance.

You can also appoint us in order to guide you through the legal process and help you in appealing for your cousin's return.

It is also important to note that the deportation order may have a ban period, during which your cousin may not be allowed to enter the UAE.

This ban period can range from 1-5 years, depending on the severity of the violation. Your cousin may also be required to pay any outstanding fines or fees before being allowed to return to the country.

In the meantime, it is important to keep in touch with your cousin and provide him with any necessary support during this difficult time.

You can also seek assistance from your country's embassy in the UAE for further guidance and support.

Please feel free to contact us via email.
