س: هل يمكن فرض منع من السفر على مدير شركة مَديّنة في قضية تنفيذ مدنية؟ لقد طلبت فرض منع من السفر على مدير الشركة. رفض القاضي ذلك لأن هوية المدير غير محددة في الترخيص التجاري (لكنه مذكور في عقد تأسيس الشركة وبعض الأحكام النهائية الصادرة عن المحكمة). بعد ذلك قدمت تظلم ضد حكم التنفيذ. لكن حكم التظلم ينص على أنه لا يمكنني ملاحقة المدير للدفع ما لم أثبت أنه ارتكب خطأ أو احتيال أو خداع من قبل المدير. وبناءً عليه، هل لا يزال من الممكن فرض منع من السفر أو إلقاء القبض على مدير الشركة بسبب تخلف الشركة عن السداد حتى بدون إثبات أي خطأ أو احتيال أو خداع ارتكبه المدير؟ وذلك وفقًا للمادة 186 من قرار مجلس الوزراء رقم 57 بشأن اللائحة التنفيذية للقانون الاتحادي رقم (11) لسنة 1992 بشأن قانون الإجراءات المدنية. يسمح القانون بالمنع من السفر أو إلقاء القبض على أي ممثل قانوني.

س: مرحبًا تدين لنا شركة في دبي بمبلغ 38000 درهم إماراتي. المبلغ مستحق منذ يوليو 2017 وقد فشلت جميع محاولاتنا لتحصيل الأموال. هل هناك أي فرصة للمضي قدما قانونًا لتحصيل هذا المبلغ، وأيضًا لوضع منع من السفر على أصحاب الشركة؟ ما هي التكلفة التقديرية لهذا؟

Q: I am being pursued for a debt of 290,000 dirhams in the UAE by twofour54, the media free zone in Abu Dhabi. The debt is historic, 10 years old, and it is a company debt, not a personal one. Q: Hello I was employed by a company in 2017 that failed to pay my salary. Since I urgently needed a new job to manage my expenses, the management gave me three cheques amounting to roughly 45,000. I signed the final settlement, which states that the remaining amount will be paid in cheques. Prior to me cashing the cheques, they had paid roughly 6,000 in cash. Since it's been a long time, I cannot locate the payment slip. Since they failed to pay the rest of the amount, I went ahead to cash the cheques and they bounced. I then registered a case with the Dubai police in April 2018. It's been nearly 7 years and the status on the Dubai Police site shows as "Awaiting approval/Bank reply". I have the following questions: 1. Is there any way to recover this amount? 2. What is the best option to pursue? Civil case or a labor case with the free zone? However, the company no longer exists as far as I know, how does it work? 3. What does the status awaiting approval/bank reply mean?

The provisions of this Law apply to the commercial companies established in the UAE and the foreign companies that have established in the UAE a base to conduct any activity therein or established a branch or representative office. The Law abrogates Federal Law No. (8) of 1984 Concerning Commercial Companies.

The law promulgates UAE Civil Procedures Code (Civil Procedure Law) which governs civil procedures in the United Arab Emirates, including the prosecution before the courts, litigation and execution.
