أنا مواطنة هندية. توفي زوجي، 44 عامًا، في 11 يناير تاركًا وراءه شركة (المالك الوحيد) يجب إغلاقها ومنزل مع رهن عقاري باسمه.
المنزل مؤجر حاليًا بعقد إيجار ينتهي في 31 مارس 2021.
الأسئلة:
1) أريد الحصول على ملكية العقار. كيف أفعل ذلك دون تطبيق الشريعة؟
2) هل يمكننا الاستمرار في عقد الإيجار حتى يتم نقل سند الملكية باسمي؟

كان زوجي يدير جراجين بموجب رخصة مهنية بصفته المالك الوحيد وهناك مبالغ مستحقة القبض وديّون واجبة السداد؛ بما في ذلك الموظفين ومالك العقار والموردين وكذلك القروض التجارية وديون بطاقات الائتمان، وما إلى ذلك.
1. هل ستؤثر التزاماته المالية على ملكية عقاري؟
2. هل يمكنني الحصول على المساعدة القانونية لبيع ترخيصه التجاري من أجل دفع رواتب الموظفين وسداد مستحقات الدائنين بمساعدة كفيله؟

هل الوصايا المسجلة في الهند للعقارات الهندية سارية في الإمارات؟
س: تم عمل وصية في الهند عن ممتلكات هندية. تنص الوصية على أن "جميع الممتلكات الأخرى المكتسبة فيما بعد يجب أن تذهب إلى زوجتي".
لم تكن هناك وصية بشأن عقار في دبي. توفي زوجي (غير المسلم) في دبي.
هل يمكنني تطبيق هذه الوصية الهندية على عقار في دبي امتلكه زوجي قبل وفاته؟
هل ستقبل المحكمة الشرعية هذه الوصية أم سترفضها قائلة إنها خاصة بالممتلكات الهندية فقط؟

س: مرحبًا،
والدي مسلم مصري الجنسية ولم يكن مقيمًا في دولة الإمارات من قبل، لكنه يمتلك أربع عقارات في مشاريع تحت الإنشاء في إمارة دبي والتي كان يقوم بسداد أقساطها.
نحن (الورثة - أنا وأختي وأمي) نرغب في نقل ملكية العقارات بأسمائنا حتى نتمكن من الاستمرار في سداد الأقساط.
أعرف أننا بحاجة إلى رفع قضية في محكمة الأحوال الشخصية للحصول على أمر من المحكمة وتقديمه إلى دائرة الأراضي والأملاك في دبي لتحديث سجلاتهم بناءً على الأمر الصادر من محكمة دبي.
لديّ المستندات التالية:
- شهادة وفاة الأب مصدقة من الخارجية المصرية وسفارة دولة الإمارات بالقاهرة.
- شهادة حصر الإرث تُفيد بأننا الورثة الشرعيون مصدقة من وزارة الخارجية المصرية وقنصلية دولة الإمارات.
- توكيل عام من أخواتي وأمي لي مصدق من وزارة الخارجية المصرية وقنصلية دولة الإمارات.
- نسخ من جوزات السفر الخاصة بنا جميعًا بما في ذلك والدي.
- عقود العقارات من المطور العقاري.

My hair was damaged by a very known and professional salon. Can I seek refund and compensation?

I went to a very well-known and professional salon (or so I thought) for a normal hair dye. The guy who did my hair left the dye on my hair for over an hour when it was supposed to be on for a maximum of 30 minutes.
He wasn’t paying attention to me walking around the store talking to everyone and also doing another customer's extensions.
Now my hair is potentially damaged, my skull burns, and is flaky (meaning the dye wasn’t ammonia-free which is extremely unprofessional for such an expensive salon).
I didn’t even get the outcome that I wanted and the dye color doesn’t even show. I talked to him about it but he shut it down so fast and gaslit me the whole time and made me feel like I was the wrong one and I was ‘complaining about something so light’.
Please let me know what I can do legally about this.

By checking in Al Adheed, I have found there is a marital matter case against me in Dubai Courts. There is a hearing date for next week and the time mentioned in the case status with a link for an online hearing.
However, I have not received any message from Dubai courts regarding this by mail or phone. I have all contact details updated with EID. In this case, what should I do?
