س: لقد فقدت وظيفتي في الإمارات. اضطررت للعودة إلى الهند بسبب بعض الظروف التي لم أستطع تجنبها ولم أتمكن من دفع متأخرات بطاقة الائتمان الخاصة بي (9700 درهم إماراتي).
لقد كان هذا منذ حوالي 4-5 سنوات. أود أن أعرف ما إذا كان هناك أمر بمنعي من السفر / قضية / أو أمر توقيف ضدي، كما أود السفر إلى الإمارات للقيام ببعض الأعمال العاجلة.
ما هو الإطار الزمني للتحقق من الوضع وإنهاء جميع المشكلات القانونية قبل السفر؟
أود التأكد من أن كل شيء تم إنهاؤه قبل أن أتمكن من السفر.

س: رفعت قضية عمالية ضد الشركة أطالب فيها بالأجور المتأخرة عن 21 شهر حيث تم توقيفي ومنعي من العمل ورفعوا قضية خيانة أمانة ضدي وأخذت براءة والحمد الله.

هل يمكن إلغاء عقوبة السجن بعد تسوية قضية شيك مرتجع؟
س: هناك قضية جنائية مرفوعة ضد أحد أصدقائي في إمارة الفجيرة بسبب شيك مرتجع قيمته 500,000 درهم.
تم رفع القضية الجنائية وأصدرت محكمة الفجيرة الابتدائية حكمًا غيابيًا ضده بالسجن لمدة ستة أشهر. يريد صديقي معرفة ما يلي:
1) إذا توصل إلى تسوية مع المدعي، فهل يمكن إلغاء عقوبة السجن حتى بعد أن أصدرت المحكمة حكمًا ضده بالسجن لمدة ستة أشهر؟
على حد علمي، إن التسوية مع المدعي تكون سارية إذا توصل كل من المدعى عليه والمدعي إلى اتفاق محدد قبل أن تصدر المحكمة الابتدائية حكمًا. إلا أنه بمجرد أن تصدر المحكمة الابتدائية حكمًا بالسجن لمدة ستة أشهر، فإنه يمكن تقليل مدة السجن أو تغييرها إلى الغرامة، ولكن لن يتم إلغاؤها بالكامل.
2) هل يمكن الإفراج عنه في اليوم التالي بعد التوصل إلى تسوية فيما يتعلق بالشكوى؟
3) ما نوع المستند الذي يجب أن يحصل عليه من المدعي بعد سداد المبلغ بالكامل؟

Can we legally act against community management for a noisy pool unit?
Hello,
We live in a development in Ras Al Khaimah, and under our apartment block, there is a loud swimming pool heater/chiller unit that runs 24/7, producing a rattling and humming noise that disturbs our peace.
We can hardly use our balcony due to this noise. Other apartments face the same issue, but the community management refuses to take action.
What legal recourse do we have? Can we serve the community management office with a legal notice?

As the HR manager of a company, I have issued a salary advance to the employee. Upon joining, he failed to go to duty and used alcohol daily in the camp.
I have a signed thumb-impression cash receipt. What options do I have to recover the AED 7000 advance paid to the employee?

What can I do about constant noise from my upstairs neighbors?
Hello,
My neighbors on the upper floor are causing noise throughout the day, almost 24/7. They keep dragging furniture, dropping heavy objects, and slamming doors.
The property manager was not very helpful, and I cannot sleep or take power naps. I sleep when they do and wake up when they wake up.
Also, there are 6 family members in a one-bedroom apartment in Dubai.

I bought an apartment, but the previous landlord is refusing to vacate it. The contract clearly states that the landlord should hand over the apartment on the day of the transfer.
Out of courtesy, I gave him three days to vacate so he could find a new place to stay, but the time has passed, and he is still refusing to vacate and hand it over.

Can we give a salary certificate to a new hired employee before he starts to open a bank account?

The new employee will start on June 1, 2025. However, he would like to open a new bank account in the UAE thus asking to provide the salary certificate mentioning his salary in AED and if possible not mentioning the start date.

Can I claim compensation for emotional distress and pregnancy loss?
Good afternoon,
A gentleman insulted me severely over the phone during a delicate moment in my life when I was pregnant. He conveyed harsh messages through chat, causing me to feel sick, panicked, and scared.
Unfortunately, I lost my baby after this incident. I have reported the matter to the police and won the case, leading to the confiscation of his phone and imposition of a fine.
However, I believe I deserve compensation for the mistreatment. Can I pursue damages, and if so, what amount can I claim for my loss and damage?

Can my company make my position redundant and hire somebody else after I was terminated?
My company terminated my employment because it was making the position I held redundant.
I was advised that in no way was this performance-related but purely a restructuring exercise.
However, within 1 month of leaving the company, they have externally recruited another person to fill my exact position, with the same job title, that they made redundant.
Whilst I believe that this is unethical behavior, could anyone tell me if this is legal within the UAE or should I lodge a complaint for unfair dismissal?
