الترحيل من الإمارات وإمكانية العودة إليها
س: مرحبًا، أنا هندي وأعيش في دبي منذ 25 عامًا. كانت لدى ابني قضية جنائية تتعلق بتزوير المستندات وقضى ثلاثة أشهر في السجن ثم تم ترحيله من الإمارات. لست متأكدًا هل تم إدراجه في القائمة السوداء وفرض عليه حرمان مدى الحياة أم لا. ينص الحكم على "السجن لمدة 3 أشهر والترحيل". لقد راجعت مؤخراً دائرة الهجرة في الشارقة ولم أجد حرمان ضده. ومع ذلك، لدي بعض التخوف من أنه سيتم منعه واعتقاله في المطار لدى وصوله بتأشيرة سياحية. هل يمكن أن تقدم لي النصيحة بشأن كيفية التحقق من الهجرة في المطار والتأكد من أنه ليس لديه أي حرمان ويمكنه دخول البلد؟ برجاء الرد علي.

س: مرحبًا يا سيدتي، اسمي م.، كنت أعمل في دبي في إحدى شركات المقاولات من عام 2006 إلى 2008. كنت دبي في حالة ركود وقتها والشركات لا ترفع الرواتب، وقام العمال بالإضراب بسبب ذلك وتقدمت الشركة بشكوى إلى السلطات المحلية. لذا احتجزتنا السلطات في السجن لمدة 4 أيام ورحلتنا من السجن إلى الهند عن طريق إجراء مسح بصمة العين في السجن (استلمنا التسوية كاملة في السجن أمام السلطات). أريد أن أعرف، هل عليّ حرمان من دخول الإمارات؟ هل يمكنني الدخول إلى الإمارات عن طريق تأشيرة زيارة؟ هل يمكنني الحصول على تصريح عمل في دولة الإمارات؟

Deported from the UAE due to expired visa: Can I return after 6 months?
Q: Hello sir/madam, My question is, can I return to the UAE after being deported? The reason for my deportation was that my visit visa had expired, and I was caught by CID and subsequently deported after being in jail. I am currently in India, and I am unsure if I can go back to the UAE. Some people have said that I can return after six months, but I am not certain. Could you please help me with this issue?

The law promulgates UAE Criminal Procedural Law (Penal Procedures Law) which governs criminal procedures in the UAE. This law applies to the procedures relating to offences whose punishments are not specified, dogma and punitive offences, and blood money, if they do not violate the Sharia rules.

The public prosecution appealed a judgment to increase the fine I already paid. What do I do now?
Good afternoon, Thank you for your time. The public prosecution appealed my judgment (a fine that I satisfactorily cleared) and requested increasing the fine. Can you please explain what happens during a criminal case appeal hearing for me as a defendant? Will I be asked questions? Is the hearing just for the Public Prosecution to present their appeal to the judge, and I do not need to give a response? Thank you again for your time.

I purchased an apartment, but the previous landlord refuses to vacate. What to do?
Hello, I bought an apartment, but the previous landlord is refusing to vacate it. The contract clearly states that the landlord should hand over the apartment on the day of the transfer. Out of courtesy, I gave him three days to vacate so he could find a new place to stay, but the time has passed, and he is still refusing to vacate and hand it over. What should I do in this case?

Can we give a salary certificate to a new hired employee before he starts to open a bank account?
Dear lawyers, The new employee will start on June 1, 2025. However, he would like to open a new bank account in the UAE thus asking to provide the salary certificate mentioning his salary in AED and if possible not mentioning the start date. Legally, can the company provide such a certificate?
