My husband has been arrested in a drug case in Ajman for two months. How to get him out?

My relative is staying with his friend. His friend was arrested for drug trading (MDMA). My husband also got arrested, but he is not involved in trading. He is a first-time offender in drug use.

He got arrested two months ago and he is in Ajman, Jurf jail. He is asking us to give money to a lawyer to make the court order and release fast.

Is it possible?

How long will it take for his release and court order?

What will be the court order?

Dear Client,

Thanks for your question!

I hope you are doing well. I will assist you in this matter.

Your relative's situation in Ajman is concerning. As a first-time drug use offender, he may face rehabilitation rather than severe punishment under recent UAE reforms.

The investigation typically takes 21 days but can be extended. Court processes vary, with potential outcomes including rehabilitation, deportation, or imprisonment.

Hiring a lawyer might help but won't guarantee a faster release. The court order and release timeline are unpredictable, potentially taking weeks to months.

The specific court order will depend on case details. While legal representation is important, there's no assurance it will significantly expedite the process.

Consulting a local legal expert for case-specific advice is recommended.

Feel free to contact us via WhatsApp for additional information or additional support. We are dedicated to providing professional, timely, and comprehensive assistance tailored to your situation.

Thank you,

ABDUL WAHIED

Greetings of the day,

If your husband was arrested for drug use as a first-time offender, his case will likely be handled under UAE drug laws, which have provisions for rehabilitation instead of imprisonment for first-time users.

However, the severity of his punishment depends on the quantity of drugs found and any other circumstances of his arrest.

Since he has already been in detention for two months, it is crucial to check with the Ajman Public Prosecution or hire a lawyer to track the progress of his case and explore options such as rehabilitation, deportation (if applicable), or reduced sentencing.

You may also submit a mercy petition.

Important: Our legal services are available to assist in securing bail for your husband.

Best Regards

Dear F,

Thank you for reaching out regarding your relative's situation. I understand the urgency of this matter and am here to provide you with the legal guidance necessary to navigate the situation.

1. Possibility of Release and Court Order

Since your relative is a first-time offender and involved in a drug use case, the following points are relevant:

First-time Offender: In UAE law, first-time offenders may face more lenient penalties, though drug-related offenses are treated very seriously.

Given that your relative is not involved in trafficking, there may be room for a reduced sentence or alternative measures such as rehabilitation.

Bail Application: A lawyer can file a bail application to request provisional release until the trial is concluded. The bail is not automatically granted in drug-related offenses, but it can be granted at the court's discretion, depending on factors such as the severity of the offense, the defendant's criminal history, and the likelihood of fleeing the jurisdiction.

It is essential to have legal representation to help with the bail application process.

2. Timeframe for Release and Court Process

The process of release or trial can vary depending on the court's schedule and the specifics of your relative's case. However, the general timeline is as follows:

Court Hearing and Bail: Once a bail application is filed, it may take a few days to a couple of weeks for the court to make a decision regarding release.

If bail is granted, your relative could be released soon after payment is made and the necessary documentation is processed.

Full Trial: If bail is not granted, the process could take weeks to months for a full trial, depending on the court's backlog. Given the seriousness of drug-related offenses, it's not uncommon for these cases to take longer to resolve.

However, it’s worth noting that with strong legal representation, the process may be expedited or the possibility of a plea bargain may be explored.

3. Possible Court Orders

In a case involving first-time drug use, the potential court orders could include:

Imprisonment: A sentence of imprisonment is a possible outcome, but the duration may be less severe compared to trafficking offenses, especially if your relative has shown remorse and is cooperating with the authorities.

Rehabilitation: Courts may offer rehabilitation as an alternative to imprisonment, especially if your relative is found to be struggling with addiction. In some cases, the court may send the defendant to a rehabilitation facility instead of imposing jail time.

Fine: There may be a financial penalty, either in addition to or instead of prison time, depending on the specifics of the case.

4. Role of Legal Representation

It is crucial to have legal representation to ensure the best possible outcome for your relative. Here's how I can assist:

Bail Application: I can file a formal request for bail to ensure your relative has the opportunity to be released while awaiting trial.

Expedited Legal Process: I will follow up with the relevant authorities to ensure that your relative's case is processed as quickly as possible.

Plea Bargaining: If applicable, I can work to negotiate a plea agreement or an alternative sentence, such as rehabilitation, that may reduce the penalties.

Court Representation: I will ensure that your relative is properly represented in court, advocating for the most lenient sentence based on his status as a first-time offender.

5. Next Steps

Bail Application: I recommend filing a bail application immediately to seek your relative’s provisional release pending trial. This process can be expedited with proper legal representation.

Court Follow-Up: I will monitor the case closely, ensuring that all procedural requirements are met and that your relative receives fair treatment under the law.

Potential for Rehabilitation: If drug addiction is a factor, we will also explore the possibility of sending your relative to a rehabilitation center, which could help mitigate the sentence.

Conclusion

While the legal process can take time, particularly in drug-related offenses, having experienced legal representation increases the likelihood of a favorable outcome, such as reduced penalties, bail, or rehabilitation.

I will assist with navigating the court system, filing the necessary applications, and ensuring that your relative’s rights are protected throughout the process.

Please let me know how you would like to proceed, and I will be happy to assist you further.

According to UAE law, a first-time drug user may face imprisonment or a fine, but the court may also order rehabilitation instead of jail, depending on the case.

The trial process usually takes 3 to 6 months. Hiring a lawyer can help speed up the proceedings and improve the defense.

For legal assistance and WhatsApp contact, feel free to reach out to us, as we specialize in such cases.

It is necessary to get a power of attorney from the detained person and visit the police station to know the report number and his legal status, and then submit a bail request to release him from detention.

Thank you for reaching out regarding your husband's situation. I understand that this must be a challenging time for you, and I will do my best to provide clarity.

Regarding your husband's arrest, as a first-time offender involved in drug use (and not trafficking), there are potential legal avenues for seeking release, depending on the specifics of the case and the evidence presented.

Generally, the process involves applying for bail, which can be expedited with the proper legal representation and documentation.

The court order will typically address the terms of his release, which could include bail or other conditions depending on the charges and the circumstances surrounding the case.

If you are looking to speed up the process, it is essential to work with a lawyer who can assist in making a strong case for bail or an expedited release.

As for the time it will take, it varies depending on factors such as the court’s schedule, the severity of the charges, and how the case is handled.

However, with the right legal steps, we can aim to move quickly. The process could take anywhere from a few weeks to a couple of months, depending on the complexity of the case and the court's workload.

I would recommend scheduling a consultation so we can review all the facts and start working on a strategy to expedite the process for your husband’s release.

Please feel free to contact me directly via WhatsApp or email me to discuss this further. I look forward to assisting you.

Best regards,

Suhail Rana
