س: لقد اشتريت عقارًا كان من المقرر تسليمه في 15 يونيو 2020 بالاستناد إلى اتفاقية البيع والشراء. كانت اتفاقية البيع والشراء تنص على أنه يحق للمطور العقاري تأخير التسليم لمدة تصل إلى 12 شهرًا (15 يونيو 2021).
أخبرني المطور العقاري أنه سيتم تسليم العقار في 15 سبتمبر 2021؛ مما يعني أنهم ينتهكون اتفاقية البيع والشراء. لقد طلبت منهم تعويضًا عن التأخير لمدة ثلاثة أشهر لكنهم رفضوا.
كيف يمكنني متابعة الإجراءات بخصوص ذلك؟ هل يجب عليّ رفع قضية مدنية؟

س: لقد حجزت شقة في مبنى قيد الإنشاء.
لقد دفعت وفقًا للخطة ولكن المطور العقاري تخلف عن إكمال البناء في الوقت المناسب لمدة عامين تقريبًا وظل العقار قيد الإلغاء وفقًا لموقع دائرة الأراضي والأملاك.
بعد ذلك استأنفوا البناء والآن أكملوا 70٪ من المشروع وحتى الآن تأخر تسليم المشروع لأكثر من ثلاث سنوات.
في الوقت الحالي، يهددوننا للحصول على الدفعة المتبقية ولكننا نريد سداد الدفعة التالية المستحقة عند التسليم وفقًا للاتفاقية.

س: يطلب مني المطور العقاري دفع 50% من سعر الشقة وهي المبلغ المتبقي بحلول 15 سبتمبر، على الرغم من أن العقار لا يزال غير مكتمل البناء (92% وفقًا للمطور العقاري).
أقرب موعد لإصدار شهادة إتمام البناء هو الأول من أكتوبر. بينما التاريخ المذكور هو آخر موعد يمكنني فيه دفع أموال التسليم دون غرامة. كيف يمكنني مناقشة ذلك مع المطور العقاري؟
ما هو المبلغ المسموح لي بحجزه بسبب الأعطال أو في حالة حدوث أي تأخير في التسليم... وما إلى ذلك؟

س: قمت بشراء وحدتين في مشروع تحت الإنشاء في دبي في أكتوبر 2019، ودفعت 15% لكل منهما من إجمالي المبالغ. تم تسجيل هذه العقارات في دائرة الأراضي والأملاك في دبي وباسمي من قبل المطور.
كما تم تأجيل هذا المشروع لمدة عامين (ربع 2020). كان الهدف من شرائي لهما هو قربهما من معرض اكسبو 2020، وقد وعدني المطور بإنهاء المشروع قبل بدء المعرض واستخدام الوحدات كفندق.
لكن المعرض انتهى بينما لم يكتمل البناء. تم الانتهاء من البناء منذ شهرين، ولكن التسليم لا يزال مستمرا حتى الآن.
الآن يضغط علي المطور لدفع المبلغ المتبقي، وإلا فسوف يقومون بإبلاغ دائرة الأراضي والأملاك وإلغاء الوحدة ومصادرة أموالي.
انخفض تقييم العقارين بنسبة 25%، ولهذا السبب لا أستطيع البيع بخسارة كبيرة. ولم أستخدمها في المعرض أيضًا.
هل يمكنني إنهاء الوحدات مع أن نسبة 100% قد اكتملت الآن قبل أن يبدأ المطور عملية إنهاء التعاقد؟

New developer wants to change payment terms. How to me to protect my rights?

Q: Dear Sir/Madam,
I bought a residential property for AED 7 million in Dubai from a developer in 2013 and registered the property in the same year. The project has been delayed and is still not complete.
The original developer sold/transferred the project to another developer in 2022. The project is now 60% complete as per the latest RERA inspection report.
The original payment terms in the Sales Purchase Agreement were a final balance payment of 40% to be payable on the handover of the property.
However, now the new developer has drafted a new Sales Purchase Agreement where he is demanding 90% to be paid in stages while construction is in progress, and only a balance of 10% to be payable on the handover of the property.
The RERA website states project completion by Dec 2025.
Please advise if the new developer has the legal right to change these payment terms.
What options are available to me to protect my investment and my rights?

Hi,
I am a landlord and need advice on the following scenario.
- The contract with my tenant expired in Sep 2024. Upon requesting the renewal, the tenant mentioned that she is out of the country and will sign the renewal contract and provide the rent checks. In the meantime, she paid the first quarter of rent through a bank transfer.
- After 3 months, when the next quarter's payment was due, she deposited the next quarter's rent into my bank but did not sign the contract renewal despite my follow-up with her multiple times. At this time, she had returned to Dubai.
- Now the next quarter payment is due, however, the tenant is not responding to WhatsApp or answering calls. She is NOT paying rent or renewing the contract.
What action can I take since she is not answering my calls or messages?
She does not have a valid contract or Ejari, and her rent is delayed by 1 month. All WhatsApp messages are delivered, but she chooses not to respond.

I was evicted from my apartment to be sold but it was gifted and rented at a higher price. What can I do? 0
I was evicted from my apartment after living there for five years. My landlord informed me a year in advance that the lease would not be renewed because he intended to sell the property.
Prior to this, he attempted to impose a rent increase that was not compliant with RERA regulations, which I refused to accept. He then served me with an official Dubai Court eviction notice, citing the need to take back the property for sale.
Five months after I moved out, I discovered the property was rented out at a much higher price. Upon further investigation, I found that the ownership was transferred as a "Gift" rather than a sale.
This makes it seem like the eviction was only to raise the rent rather than a genuine need to sell.
Do I have a valid case for wrongful eviction against my landlord?
Also, under Dubai law, does transferring ownership as a "Gift" hold the same legal grounds as selling in justifying eviction?

I'm an Irish citizen and a resident of the United Kingdom. I got investment fraud in Dubai. I invested money into a business with a Pakistani national guy in March 2024 via bank transfer into his business account.
Now he's giving back the money which I invested in business after 9 months. He's preparing a letter from a local lawyer to kick me out of the business. I do not have any other option than to take out at least my money.
But it's unfair to me that he used my money in business and took all the advantage.

I'm staying in JLT in a house with a rent of AED 140,000 per year. The lease starts on 1st Sep '23 and expires on 31st Aug '24.
The landlord sent me a legal notice from the Dubai Courts in mid-Sep '23, giving me 1-year notice to vacate the house as he plans to sell the house. The notice was received by me through email from the court.
He claims the email notice sent by the court is not valid till I receive it by courier via Aramex for my physical signature. Can you please confirm if this is true?
The landlord is now ready to let me stay in this house for two more years. He has proposed that we maintain the existing lease agreement and Ejari. However, I should pay him AED 14,000 in cash (10% increment).
We will sign a separate paper document wherein we will agree that I will further rent increase of 10% (10% on (140,000+14,000)) on 1st Sep'24 when my current lease expires.
Should I insist on making a fresh written contract with the higher rent (140,000+14,000=154,000)?

I have signed Form F and got the mortgage but the seller is in breach. What to do? 0

I have signed the MOU Form F since July 2023 and we prepared all the papers and the loan from my end on 23/8/2023.
When I went to DLD for the transfer, the seller had registration issues and asked for some papers to be provided as the property is under the company not an individual.
Since that time, we have kept renewing the MOU every month in the hope of finalizing but I am not seeing any progress.
So I am asking about legal action as I already got a bank mortgage and started paying as well but not seeing any progress from the seller.
So I need to ask the following:
1. If my MOU expired on 20.11.2023, can I file a complaint on 20 or after a couple of days like 23?
2. What will happen in terms of 10%? Will it be returned and what about the fees paid to the bank like mortgage fees, evaluation, and cancellation of loan? Will the EMI payment be compensated by the seller?
3. What is your advice?
