Can a debt agency access AECB reports without consent for a 15-year-old closed case?

I would greatly appreciate your advice and guidance regarding a troubling issue my colleague is facing with a collection agency.

The company has been contacting the employer, urging them to ask my colleague to get in touch with them regarding a supposed liability.

This claim is related to a 15-year-old closed dispute with a bank credit card, and the issue seems to stem from outdated and inaccurate information on the AECB report.

Our main concerns are as follows:

Unauthorized Access: The company is accessing her AECB report without her consent. She has never given permission for them to retrieve or view her personal financial information.

How is it possible for a third-party agency to openly access and track AECB reports, especially for a dispute that was resolved 15 years ago?

If the agency continues its illegal practices, your colleague may file a lawsuit against it for data privacy breach or illegal practices under UAE laws.

Why are these companies contacting employers directly without ever reaching out to the individual through official channels?

They are calling non-stop without providing any proof of outstanding claims. If there is a valid, unresolved claim, why aren't they communicating through the registered email address and sharing official documentation or claims?

Why is this approach being used? Additionally, how do these companies have access to sensitive personal information, such as an employee's labor and Emirates ID details?

How are they able to access Ministry of Human Resources (MOHRE) records and contact employers directly? How is this possible, and why are such practices being allowed when they clearly violate regulations in the UAE?

Why do they feel entitled to act in this manner, knowing that such practices are not permitted under UAE laws?

They have the defense that the liability is not settled yet. Even if you approach the authorities, such as the police, they can submit their agreement with the banks.

They believe that if they can reach the employer, the defaulter can be easily convinced and may agree to their payment plan.

This is an entirely wrong and outrageous practice. Once the employer is contacted, they often terminate the employee, which amounts to defamation and harassment, especially when the individual has never been contacted through their registered details.

This raises the troubling question: Do these agencies believe they have the right to act freely in the UAE, engaging in such practices without any consequences?

Does this mean there is no law in the UAE that governs their methods of tracking, tracing, and retrieving personal records, including AECB data?

In my colleague's case, the amount was cleared while she was under detention at the police station.

However, her AECB report still reflects the liability because the bank has yet to send an update to the AECB authority to reflect the cleared status.

As a result of the outdated AECB report, these third-party agencies feel entitled to trace MOHRE labor and AECB records and contact employers.

This is a harsh and unethical practice. UAE law does not regulate such brutal actions, including tracing personal records and contacting employers without proper communication with the individual through registered channels.

This situation is a clear example of how openly they are allowed such rights.

First, you can file a complaint with the police; falsely contacting an employer with defamatory claims can be considered a criminal offense.

Harassment and spreading false information fall under the purview of the Dubai Police's Cybercrime Unit and General Criminal Investigations.
