Q: Hi, I am working in Dubai under an unlimited contract. As per the labour contract, the probation period is 6 months and I resigned from the company in Jan. The notice period is 3 months from both parties but I am not sure if resigning during the probation requires this notice period of 3 months. Please advise if they have any right to hold my salary in case I resign and leave the company.

Q: I am in my probation period. My visa is a free-zone visa and my contract is an unlimited contract. The company is giving me additional work which is out of my job description due to the resignation of an old employee. I am really struggling to complete all the responsibilities including mine and that of the ex-employee. Can I resign without getting a labour ban? Do I need to pay them anything?

س: أعمل بموجب عقد عمل غير محدد المدة وما زلت في فترة الاختبار. كما أنني أعمل في إحدى المناطق الحرة. ينص العقد على أنه في حالة الاستقالة قبل مرور عام واحد، فإنه يجب علي أن أتحمل تكاليف استخراج وإلغاء التأشيرة، وتذاكر السفر،... وما إلى ذلك. ماذا لو استقلت بعد مرور ستة أشهر وقضيت فترة إشعار مدتها 30 يومًا، كيف يمكنني تحديد المبلغ الذي يجب علي أن أدفعه؟ هل يجب علي أن أدفع حقًا، وهل سيتم فرض حرمان من العمل علي؟

Q: I was working in a company in Dubai on a family visa. I was not provided with any labour contract during my tenure. I have resigned under probation serving 7 days of notice period as per their contract. They also deducted my 1 month & 8 days of salary by considering it as training and licensing cost. Now the HR and the manager are not responding to me to clear my incentives and complete my exit process. I also want to know whether the employee is supposed to bear the cost of licensing (DHA) if he/she resigns under the probation period.

The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

This Decree sets the rules and conditions for the termination of fixed-term (limited) or unlimited (not term-bound) employment contract between employer and worker in the United Arab Emirates.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
