Non-renewal of a rental contract because of disagreement and COVID-19

Hi,

I hope everyone is staying safe. My rental contract is up for renewal 16 Apr 2020 and I wanted to know what my rights are in the current economic climate.

I have been negotiating with the landlord since the correct time (90 days) but have so far been unsuccessful in reaching an agreement that both sides are happy with.

Talks are still ongoing and I hope to find a resolution but I want to have a full understanding of what my rights are in the event no agreement can be reached.

If we do not renew, we also don't have the ability to view other homes or move due to coronavirus. Assuming no renewal is agreed by 16 Apr 2020, what happens?

Thanks!

Dear questioner,

I presume that you have served notice of not renewing to your landlord before the 90 days. If you did not reach an agreement, you can advise the landlord that you are not renewing and due to current circumstances, you will not be able to leave the building.

You will leave as soon as life is back to normal. In this case, you will pay rent on the old rate as long as you stay on the unit without the obligation to renew.

Hi Mohamed,

Thanks for coming back to me. Thats where the confusion lies, no notice has been served, but we have been speaking, going back and forth, trying to find a resolution.

This is why I am not sure what exactly the rules are and what our rights are. Now, we are within the 90 days, does it matter that we have been communicating?

What happens if no renewal agreement is reached? Are we able to not renew and vacate when things are back to normal? If so, do we just pay monthly rent to the landlord?

Thanks!

It depends on communication nature.

What happens if no renewal agreement is reached?

Renewal date is to be reached according to the agreement, subject to the agreement, which I think it is another period.

Are we able to not renew and vacate when things are back to normal? If so, do we just pay a monthly rent to the landlord?

You try to convince the owner that the contract has been terminated already and see if you can pay this monthly payment or commit to the contract.
