Q: My landlord has requested the A/C company to bill the district charges to me. I have lived in the apartment for the past 2 years. Last week I received a bill with backdated charges since October 2016.
My contract states I am responsible for water and electricity and does not mention A/C. I have paid for the usage of all the utility bills since moving in there.
Who is responsible for the district cooling charges, and if it is the landlord, how can I stop the A/C company from billing me?

Early termination of a lease without a proper tenancy agreement

Q: Hi,
A security deposit of AED 3,500 was paid to the landlord when I moved in and rental payment for each month was monthly. I moved out for personal reasons 4.5 months later and all rental payments were made for my time there.
At the time of viewing the room, it is being claimed that the landlord stated the minimum term was 6 months, which was never put in writing or was it ever confirmed I would lose my deposit even when I gave my 30 days notice. There is no contract or correspondence to confirm any of this.
The landlord lives in the property and is refusing to return any of my deposit. She is ignoring me now by blocking my number. I even offered her just over AED1,000 as a pro rata settlement as a goodwill gesture, but that is when she blocked me after she read it. I refused her 50/50 offer.
If filing a complaint can cost AED 2.5k-3k where do I stand it seems like a pointless exercise, I don't think RERA will look at it? Do I go to the police? I'd prefer to avoid this option.

Responsibilities of a landlord

Q: Earlier on this year one of the 25 foot Palm Trees in my garden was blown down in the high winds, luckily this Palm Tree did not hit the house or do any major damage. The reason for the tree blowing down was that the inside trunk had been eaten away by some kind of insects.At the time I raised my concern to the landlord that the other palm trees could be infected as well. A few weeks ago, I got the Palm Trees cleaned and one of the other trees has had half the trunk eaten away by insects. Now this tree could also potentially fall down in high winds.I have asked the Landlord if he could arrange for taking this tree down and remove it, but he says this is covered under garden maintenance and it is my responsibility.I must admit I was quite surprised that the Landlord took this attitude, as the tree could potentially fall on his property or the neighbours!Please let me know in cases for removals of trees from the garden, who is responsible for this, the Landlord or the tenant?

Forged compensation claim by the tenant for maintenance evacuation

Q: Hi.
I am an owner of a studio. My tenant informed me about some floor tiles breakage. So, with his suggestion and consent, I decided to get the whole floor retiled. He agreed to move out for 3-4 days.
The work was completed in exactly 4 days and I paid for the job. However, it took me two weeks before that to decide a good contractor for the job. All that while he was occupying the apartment. He only left for 4 days.
Now, he has registered a case against me for compensation of AED 8000 as he lied and said he couldn't occupy the apartment for one whole month.
The mediator called me and asked me if I'm willing to pay him one month's rent as compensation to which I refused.
Now, our hearing is on 4th March.
Please advise.

لدي حالة هنا، لقد استأجرت شقة وتم الاتفاق على دفع الإيجار عن طريق 6 أقساط. دفعت القسط الأول نقدًا، والباقي عن طريق شيكات بتاريخ مؤجل، بالإضافة إلى شيك ضمان.
الموقف المثار الآن هو أن المالك لم يوقع العقد بسبب بعض القضايا الخاصة بالمبنى في المحكمة، ولم أستلم الشقة بالمخالفة لما تم وعدي به.
هل يمكنني إلغاء الشيكات الخاصة بي مع احتمال اتخاذ أي إجراءات ضدي لأنني لم أتسلم الشقة كما هو متفق عليه، وهل يجب أن أقدم شكوى للشرطة؟ هل هناك أي إجراء أخر أحتاج إلى اتخاذه؟

عواقب استئجار شقة دون إبرام عقد إيجار

س: نحن نطالب بإبرام عقد إيجار لشقتنا.
لكن وكيل العقارات أخبرنا أنه لا يستطيع إصدار عقد إيجار في الوقت الحالي لأن القانون قد تغير ولا يمكن إبرام عقد إيجار إلا للعقارات التي يبلغ إيجارها 45000 درهم أو أكثر.
هل هذا صحيح؟

ما يجب فعله إذا فشل المالك في إنهاء تجديدات الوحدة المؤجرة في الوقت المحدد؟

س: طاب يومك.
لقد وقعت عقد إيجار من خلال وكيل في أبو ظبي بتاريخ 24 يونيو مع تاريخ بدء الإيجار في 1 يوليو.
لم ينتهي المالك بعد من أعمال الإصلاحات/إعادة الطلاء بعد المستأجر السابق وتم التأكيد من قبل الوكيل والتي سيتم الانتهاء منها في غضون أيام قليلة.
لقد دفعت وديعة، ورسوم الوكالة، والدفعة الأولى لمدة 6 أشهر. لقد استلمت المفاتيح في الثاني من يوليو ووجدت الوحدة المستأجرة دون إجراء أي إصلاحات أو إعادة طلاء بشكل كبير.
أعدت مفاتيح العقار في نفس اليوم إلى الوكيل وطلبت الاتصال بالمالك لتصحيح جميع أوجه القصور قبل الانتقال.
أشعر بالقلق من أنه لن يتم فعل أي شيء لحل هذه المشكلة على الفور (أدرك أن المفتاح لم يتم يستلمه المالك بعد من الوكيل، لذا لم تبدأ الأعمال بعد).
ماذا يمكنني أن أفعل في هذا الموقف؟
ما هي العملية إذا كنت أرغب في إنهاء العقد واسترداد أموالي مقابل الإيداع ودفعة واحدة (بالإضافة إلى مدفوعات الوكالة)؟

Landlord's breach regarding water supply and finding buyers for farm's yield. What to do?

Q: Dear Sir/Madam,
I rented a farm in Umm Al Quwain, and the landlord agreed to provide free water, supplying 50m³/day during winter and up to 120m³ for the rest of the year.
He also agreed to assist in finding buyers for the yield and fresh alfalfa for camels and cattle. However, he doesn't want to supply the water and about helping find buyers, he says "This is not my job."
Of course, guarantee checks are given and now I refuse to pay since he doesn't fulfill his obligations. I tried to communicate but the sole reply I get now is: "I don't care about the agreement and I am very powerful."
Of course, the check is handed over to the bank and since I emptied the account, it will bounce. I am faced with two conflicting replies that contradict my business etiquette.
What steps should I take next?

Hello,
My employer fired me under Article 44 for not showing up for work for 7 days in a row. But that’s not the case at all. I was sick and the management was aware and they let me go.
I went to another country to get treatment because it’s expensive in Dubai. My employer did not pay me my salary for the month I worked and fired me.
I have official sick leave from another country and there is correspondence where my employer sent me to another country for treatment.
The problem is that the employer says that he will take compensation for the training that was specified in the contract, but I did not undergo training at all; I immediately started work from the first day of work and there was no training.
Does my employer have the right to charge me such a fee and not pay my salary?

How to cancel the MoU to buy an apartment with the broker if the bank did not approve the loan? 0
Hi,
I have a situation where I signed an MoU and gave my security deposit to the seller's agent. However later, the bank valuation of the property is lower than the selling price.
On my MoU, it has a clause that “the buyer has a right to cancel/negotiate if the bank valuation is not the same as MoU.” I tried to negotiate, however, we didn't agree on the price so I asked to cancel.
Now the agent is threatening me that they will not cancel the MoU and that will deposit my cheque. Later I also came to know that the person I am dealing with is not the same person whose name is mentioned as a broker in the MoU.
The agent I am dealing with is constantly messaging me with threats. I decided not to speak to him and instead, I wrote an email to the broker whose name is mentioned on the MoU but received no response.
I am on a very tight timeline as I need to vacate my apartment in 3 weeks, I found another unit but I don't know if I can pursue this while the initial MoU still not canceled.
Please, I need advice.
