Repercussions on the employee for terminating a limited employment contract
Hi,
I am working in a company in DMCC with a limited contract. I am in my probation period right now and I would like to leave the company because of the toxic work environment.
I am ready to give 30 days notice period. This is my 3rd company in the UAE and this is the first time I want to leave in my probation period.
Is there anything more I need to do other than the notice period? Should I pay any money? Would be there any ban? What would be the other procedures?
Hello.
According to the UAE Labour Law “… the worker shall be bound to compensate the employer for the loss incurred thereto by reason of the rescission of the contract, provided that the amount of compensation does not exceed the wage of half a month for the period of three months, or for the remaining period of the contract, whichever is shorter unless otherwise stipulated in the contract.”
This penalty equates to approximately 45 days of pay, calculated on basic salary.
The company can seek to impose a ban.
We recommend you to review your contract carefully and achieve a mutual agreement with the employer.
Kind regards.
